The US Environmental Protection Agency (EPA), Office of Air and Radiation (OAR), National Vehicle and Fuel Emissions Laboratory (NVFEL), intends to negotiate, on a sole source basis, under the authority of FAR 13.106-1(b)(1), with X-Ray Optical Systems Inc (XOS) for the purchase of one SINDIE Gen 3 Monochromatic Wavelength Dispersive X-Ray Fluorescence (MWD-XRF) Spectrometer for the measurement of sulfur in gasoline and diesel fuels. US EPA requires an instrument capable of measuring sulfur in gasoline, diesel fuel, jet fuel, kerosene, biodiesel, biodiesel blends and gasoline-ethanol blends in accordance with ASTM D7039, using ETNOM sample film. X-Ray Optical Systems Inc (XOS) holds patents related to the SINDIE Gen 3 Monochromatic Wavelength Dispersive X-Ray Fluorescence (MWD-XRF) Spectrometer and is the only known spectrometer that can analyze the report results in accordance with ASTM D7039. However, any firm believing itself capable of meeting EPA?s requirement may submit technical documentation to establish the potential of complying with the specifications. Such documentation must be submitted to the point of contact within 15 days of the posting of this notice. A determination not to compete the proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered only for the purpose of determining whether to conduct a competitive procurement or to proceed on a sole source basis.
