About this opportunity
The Department of State seeks legal services in employment law for Mission Nairobi, with proposals due July 30, 2026, at 4:00 PM EAT. The procurement is a retainer or Blanket Purchase Agreement with a one-year commitment running September 1, 2026, through August 31, 2027, and the Government intends to award to the responsible company submitting the lowest acceptable offer based on initial proposals without discussions, though discussions may occur with companies in the competitive range if needed.
Place of performance is Nairobi, Kenya. The contractor must maintain a physical office in Nairobi and be certified to practice in Seychelles, Somalia, and Kenya. Minimum qualifications include 10 years' employment law experience, active legal credentials in all three countries, demonstrated experience with diplomatic missions or international organizations, and a designated English-speaking point of contact with committed response times. Contractor responsibilities encompass legal analysis and opinions, review and drafting of legal documents, representation in negotiations and proceedings, legal research, and monthly status reports and legal memoranda.
Pricing is structured as a sample chart including flat fees for initial consultations, document and contract reviews, and contract drafting; hourly rates for representation; and applicable fees for agency charges and wrongful termination cases. Invoices must be submitted monthly or upon milestone completion through the Embassy's ILMS platform in local currency by Electronic Funds Transfer within 30 days of receipt. The Government will not reimburse Value Added Tax; all invoices must show 0% VAT per Kenya's VAT Act, 2013.
Evaluation uses a two-factor process: Factor 1 applies minimum pass/fail requirements (valid legal credentials, approval to practice in the three countries, Nairobi office, employment law expertise); Factor 2 assesses capability and past performance including practice longevity, government and international organization experience, response times, and professional references. The NAICS code is 541199, All Other Legal Services, and the PSC code is R418, Support–Professional: Legal.
