About this opportunity
The United States Patent and Trademark Office announced its intent to sole-source a logical follow-on contract to The Building People LLC for design, space planning, TRIRIGA administration, and building management support services, with questions due by September 18, 2026. This procurement is exempt from full and open competition under the Patent and Trademark Office Efficiency Act (35 U.S.C. 2(b)(4)(A)) and PTAG Part 6.1.1, allowing the agency to bypass standard Competition in Contracting Act procedures. The Building People, a large business based in Leesburg, Virginia (UEI: H294NPGNMEB5), is currently customizing the IBM TRIRIGA Integrated Workplace Management System for USPTO-specific requirements, including system configuration, module development, report and dashboard creation, user support, and integration with design, space planning, and occupancy management operations. Work is performed at USPTO Headquarters in Alexandria, Virginia and other USPTO facilities. The sole-source justification rests on continuity: awarding to a new vendor would disrupt active TRIRIGA implementation activities that remain under development and have not yet achieved full operational capability. The scope falls under NAICS 561210 (Facilities Support Services). This notice is not a competitive solicitation and the subsequent contract action will not be posted on SAM.gov. Interested parties may submit written questions to Christopher Ward (Christopher.ward@uspto.gov) or Yen Nguyen (yen.nguyen1@uspto.gov).
Notice text
PTAG Part 6.1.1 – Intent to Sole Source
For this procurement, the USPTO is exempt from most of the Competition in Contracting Act (CICA) as the subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act 35 U.S.C. 2(b)(4)(A). The full text is located here: https://federalregister.gov/a/2013-24316. As a result of its exemptions, the USPTO is not required to meet the test of “full and open competition” as defined in FAR Part 6 and may use agency-specific acquisition procedures as described below when the circumstances warrant it and it is in the best interest of the agency to do so.
We have identified THE BUILDING PEOPLE LLC located at 215 Depot Ct SE FL3, Leesburg, VA 20175-3017. UEI: H294NPGNMEB5, a large business as the sole contractor able to effectively continue work on the IBM TRIRIGA configuration and as they are currently performing the system-related and integrated design tasks which remain unfinished. NAICS 561210 Facilities Support Services.
Specifically, the United States Patent and Trademark Office (USPTO) intends to award a logical follow-on sole-source purchase order to The Building People (TBP) to build upon and continue the interior design service support work utilizing and re-configuring the IBM TRIRIGA Integrated Workplace Management System (IWMS) for the administration, configuration, and support services at USPTO Headquarters in Alexandria, Virginia and other USPTO facilities.
TBP are currently in the process of customizing and adjusting the USPTO’s IBM TRIRIGA platform to meet USPTO-specific business requirements, including system configuration, module development, report and dashboard creation, user support, and integration with USPTO design, space planning and occupancy management operations. It would not be fiscally responsible, prudent or in the best interest of USPTO to solicit new vendors at this time.
This action ensures continuity of ongoing system integration and development efforts and prevents disruption to active TRIRIGA solution implementation activities that have not yet reached full operational capability.
As a result, per PTAG 6.1.1 (d) USPTO intends to negotiate and award a logical follow-on firm fixed contract with The Building People LLC to meet this requirement.
This notice of intent is not a request for competitive proposals, nor will a solicitation be issued to the public. Any questions regarding this notice must be submitted in writing via email to the following point of contact (POC) and alternate point of contact no later than 9:00 AM ET on Friday, September 18, 2026
