About this opportunity

Army Contracting Command intends to solicit recycling collection and disposal services for U.S. Army Garrison Rhineland-Pfalz (USAG RP) in Germany, with a response deadline of October 15, 2026; the contracting officer has determined that small business set-aside is not in the Army's best interests due to requirement for German legal compliance and availability of local sources, and will solicit both local and SAM.gov sources.

Performance will occur across six USAG RP installations within Kaiserslautern County, Germany, during normal operating hours (07:00–17:00, Monday–Friday, excluding holidays) with emergency and inclement-weather response capability required. The contractor must be certified as a "Waste Management Company" (Entsorgungsfachbetrieb) under German law and comply with German and Host Nation environmental law.

Services include collection, transportation, segregation, storage, and disposal of recyclable materials (paper, cardboard, scrap wood, plastics, metals, wheels and tires, electronics, and glass bottles); supply, maintenance, and service of approximately 150 collection bins, containers, and compactors; potable pedestals; and collection vehicles (minimum two pickup trucks, one bucket-vehicle, two slide-vehicles, and one glass-container vehicle, plus one reserve of each type). The contractor must handle approximately 300 pickups per month and dispose of approximately 80 metric tons of recyclables monthly.

The contract is a five-year Firm Fixed Unit Price Requirements type under FAR Part 12 (commercial services), effective from May 6, 2027 through May 5, 2032 across five one-year ordering periods. The contractor must complete mandatory security training, establish a Quality Control Plan within 30 working days of award, and designate a Project Manager and Quality Control Manager as key personnel available during normal duty hours.

NOTE on SMALL BUSINESSES SET-ASIDE

FAR Part 19.000(b)(1)(ii) states “Contracting officers may apply this part outside the United States and its outlying areas.” The contracting officer has determined that it is not in the best interests of the Army to use FAR Part 19 small business programs for this acquisition. In coming to this determination, the contracting officer considered that the contactor must be knowledgeable of, and comply with, local labor and other laws when performing these services in Germany. In light of this requirement, and given the availability of local sources, the contracting officer intends to solicit local sources as well as post the solicitation to SAM.gov. As such, there is no reasonable expectation that offers will be obtained from at least two responsible small business concerns IAW FAR Part 19.502-2(b)(1). Even if two small businesses offered to perform the requirement, the award would not reasonably be expected to be at fair market prices as required by FAR Part 19.502-2(b)(2) since the additional cost for a US-based small business to perform this requirement in Germany would likely be substantial. Further, the services required are routinely available such that award to a small business concern would not be in the interest of maintaining or mobilizing the Nation’s full productive capacity, war or national defense programs IAW FAR Part 19.502- 1(a)(1). As the contracting officer has determined not to apply FAR Part 19 to this procurement IAW the discretion afforded by FAR Part 19.000(b)(1)(ii), the contracting officer will not request review by the SBA procurement center representative IAW DFARS Part 219.402(c)(iii)(E), and no Form DD 2579 will be prepared.

No requests to be added to the interested vendor list or to receive notification of the issue of the solicitation by telephone or mail will be accepted. Requests to be added to the interested vendor list shall be by email only and may be sent to Oddny Gerstner, Contract Specialist, TCC-ESD at oddny.r.gerstner.civ@army.mil and Kathryn Cortes, Contracting Officer, TCC-ESD at kathryn.r.cortes.civ@army.mil.

This requirement is currently unfunded. Award will be withheld pending receipt of sufficient funds. The closing date annotated is an estimate date and may be adjusted dependent upon the date of release of the solicitation; however, the solicitation will not close prior to the closing date stated above.
