About this opportunity

The U.S. Army Corps of Engineers - Omaha District has issued a Special Notice for a sole source, firm-fixed price utilities contract with KEM Electric Cooperative Inc. The notice outlines the government's intent to award a contract for electric service to specific recreation areas in North Dakota, including Beaver Creek, Hazelton, and Cattail Bay. This special notice is prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 and uses the statutory authority of 10 U.S.C 2304(c)(1) for a non-competitive acquisition. The contract falls under the NAICS code 221122 for Electric Power Distribution, with a small business size standard of 1,100 employees. The notice explicitly states that this is not a request for competitive proposals or quotations.

The primary objective of this special notice is to establish electric service for government facilities in the specified North Dakota recreation areas. Contractors interested in challenging the sole source determination must provide clear and convincing evidence that competition would be advantageous to the government. All written responses must be submitted to erin.m.patton@usace.army.mil by 2 pm CDT on February 14, 2025, with oral communications being unacceptable. If no affirmative written responses are received by the deadline, the government will proceed with the award to KEM Electric Cooperative Inc. without further notice. The contractor is required to provide electric service consistent with all applicable laws, regulations, permits, and electric codes, meeting the specific service requirements of the facilities. The government retains sole discretion in determining whether to compete this proposed requirement, and no costs incurred by respondents will be reimbursed.
