Contract Nursing Homes are needed in specific areas to allow Veterans to be close to their families and allow the Veterans a choice in their care. This choice was established by Public Law 88-450, which created VA's nursing home (NH) programs. It established an expectation that Veterans would receive care in NHs close to their families and communities, if they choose this option. This expectation of choice was also included in an Information letter dated October 9, 2013, titled Veteran Choice in Nursing Home Placement. This facility currently has veterans who have chosen this Nursing Home, residing in it under the current Basic Ordering Agreement, which expires May 31, 2015.

Not being able to provide nursing home care services according to the veterans' choice and or the choice of the veterans' families will result in undue hardship, inconvenience and adverse psychological trauma to the veterans and their families. This would be counter to the purpose of the CNH program which is to optimize and maintain the highest level of medical care and quality of life for the veteran and their family.
