About this opportunity

The Executive Office for United States Attorneys (EOUSA), part of the Department of Justice, has issued a Notice of Intent to Sole Source for FOIAXpress software. The agency intends to award a purchase order to OPEXUS, located in Washington, DC, under FAR 6.302-1 authority, which allows for sole source procurement when only one responsible source can satisfy the agency requirement. This procurement covers FOIAXpress software, which is an electronic FOIA case management and processing system that includes document redaction capabilities, correspondence tracking, and action tracking tools. The software will serve EOUSA and provide collaboration tools for the 94 United States Attorney's Offices nationwide. The anticipated contract structure includes a base year plus four option years for software licensing, maintenance, upgrades, and support services.

The purpose of this Special Notice is to inform the contracting community of EOUSA's intent to proceed with a sole source acquisition, as FOIAXpress is identified as the only web-based FOIA case management software capable of providing all required functionality for effectively processing Freedom of Information Act and Privacy Act requests. Interested parties have until July 30, 2025, to submit information for the government's consideration, with responses due within five days of the notice publication date and directed to Contracting Officer Bryant Gilbertson via email. This notice explicitly states it is not a request for competitive quotations and no Request for Quote will be issued. The government reserves sole discretion in determining whether to compete this procurement action. The notice discourages telephonic inquiries and emphasizes that any responses received will be considered but do not guarantee a change from the intended sole source approach.
