About this opportunity

The U.S. Army Corps of Engineers (USACE), Jacksonville District, has issued a Special Notice of Intent to Sole Source a contract to the University of Central Florida (UCF) for sea turtle surveys and monitoring at the Brevard County South-Reach project. The notice describes a sole-source procurement due to an unexpected delay in the project implementation caused by an "act of God" incident affecting the assigned dredge. UCF is identified as the sole qualified contractor for this work, primarily because they are the only Marine Turtle Permit Holder for the specified Brevard County locations. The procurement will be conducted under Federal Acquisition Regulation 6.302-1, which allows for non-competitive acquisition when only one responsible source can satisfy agency requirements. The notice was posted on January 27, 2025, with a response deadline of February 6, 2025.

The primary objective of this special notice is to secure continued sea turtle monitoring services for the Brevard County South-Reach project, with UCF being the exclusive contractor capable of performing the required services. Eligibility is strictly limited to UCF due to their unique Florida Fish and Wildlife Conservation Commission permit status, which prevents other entities from obtaining a duplicate permit for the same geographical area. The contract will be classified under NAICS code 541620 for Environmental Consulting Services, with a specific focus on endangered species monitoring. Contractors interested in understanding future opportunities are invited to contact Ms. Brittany Jackson or Mr. Dustin Furrey from USACE to discuss potential service offerings. No public solicitation will be posted for this requirement, and the procurement will proceed directly with UCF under the sole-source authority outlined in the notice.

Notice text

NOTICE OF INTENT TO SOLE SOURCE

The U.S. Army Corps of Engineers (USACE), Jacksonville District established a contract with The University of Central Florida (CAGE 9H673), of Orlando, FL, on a sole-source basis IAW FAR 13.106-1(b)(1), to survey nesting, threatened and endangered (T&E) sea turtle species at the project footprint of the Brevard County South-Reach project.

Due to an “act of God” incident occurring to the dredge assigned to the Brevard County South-Reach project, there is a delay in the project implementation schedule and additional monitoring is required. The Government intends to modify the existing contract and solicit The University of Central Florida on a sole-source basis under the authority of 10 United States Code 3204(a)(1) as implemented in Federal Acquisition Regulation 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

A sea turtle monitor is required for this effort and must be permitted by the state. Under Florida Statute 379.2431 (1) and Florida Administrative Code Rule 68E-1, the Florida Fish and Wildlife Conservation Commission (FWC) can only issue one permit for sea turtle conservation work if there is a need for that activity. On beaches where FWC has already issued a permit to an individual, organization, or firm to conduct nesting surveys, the FWC does not issue a second permit unless additional activities not being conducted under the standing permit exists. The University of Central Florida is the only Marine Turtle Permit Holder for the Brevard County locations identified in the Performance Work Statement (PWS). As the only Marine Turtle Permit Holder, the University of Central Florida is the only contractor qualified to perform the services in the PWS.

Based on the foregoing, the University of Central Florida is determined the only responsible source. This requirement will be solicited using other than full and open competition in accordance with FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

No solicitation will be posted for this requirement.

The applicable North American Industry Classification System (NAICS) code assigned to this procurement is 541620, Environmental Consulting Services.
