About this opportunity
The U.S. Army Corps of Engineers (USACE), Jacksonville District has issued a Notice of Intent to Sole Source a contract modification to The University of Central Florida for sea turtle surveys and monitoring related to the Brevard County Mid-Reach project. This Special Notice, posted on January 30, 2026, indicates the government's intent to award a contract on a sole-source basis rather than through full and open competition. The contract modification is necessitated by an "act of God" incident that damaged the dredge assigned to the project, causing delays and creating a need for additional monitoring services. USACE is exercising its authority under 10 United States Code 3204(a)(1) and Federal Acquisition Regulation 6.302-1 to pursue this non-competitive procurement. The environmental consulting services are classified under NAICS 541620 with a PSC code of B509 for special studies and analysis related to endangered species.
The primary objective is to monitor nesting and threatened and endangered sea turtle species within the project footprint of the Brevard County Mid-Reach initiative. The University of Central Florida has been identified as the only responsible source capable of performing these services because it is the sole Marine Turtle Permit Holder authorized by the Florida Fish and Wildlife Conservation Commission (FWC) for the Brevard County locations specified in the Performance Work Statement. Florida Statute 379.2431(1) and Florida Administrative Code Rule 68E-1 restrict permit issuance to one entity per location unless additional activities beyond the existing permit scope are required. The federal deadline for interested parties to submit comments or provide information regarding this sole-source determination is February 13, 2026. The contract requires a state-permitted sea turtle monitor to fulfill the monitoring and survey obligations, making regulatory compliance and specialized expertise essential qualifications.

NOTICE OF INTENT TO SOLE SOURCE
The U.S. Army Corps of Engineers (USACE), Jacksonville District established a contract with The University of Central Florida (CAGE 9H673), of Orlando, FL, on a sole-source basis IAW FAR 13.106-l(b)(l), to survey nesting, threatened and endangered (T&E) sea turtle species at the project footprint of the Brevard County Mid-Reach project.
Due to an "act of God" incident occurring to the dredge assigned to the Brevard County Mid-Reach project, there is a delay in the project implementation schedule and additional monitoring is required. The Government intends to modify the existing contract and solicit The University of Central Florida on a sole-source basis under the authority of 10 United States Code 3204(a)(1) as implemented in Federal Acquisition Regulation 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
A sea turtle monitor is required for this effort and must be permitted by the state. Under Florida Statute 379.2431 (1) and Florida Administrative Code Rule 68E-1, the Florida Fish and Wildlife Conservation Commission (FWC) can only issue one permit for sea turtle conservation work if there is a need for that activity. On beaches where FWC has already issued a permit to an individual, organization, or firm to conduct nesting surveys, the FWC does not issue a second permit unless additional activities not being conducted under the standing permit exists. The University of Central Florida is the only Marine Turtle Permit Holder for the Brevard County locations identified in the Performance Work Statement (PWS).
As the only Marine Turtle Permit Holder, the University of Central Florida is the only contractor qualified to perform the services in the PWS.
Based on the foregoing, the University of Central Florida is determined the only responsible source. This requirement will be solicited using other than full and open competition in accordance with FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
No solicitation will be posted for this requirement. No telephone requests will be honored.
The applicable North American Industry Classification System (NAICS) code assigned to this procurement is 541620, Environmental Consulting Services.
