About this opportunity
The U.S. Army Corps of Engineers (USACE), Jacksonville District, has issued a Special Notice announcing its intent to sole-source a contract modification with the University of Central Florida (UCF) for sea turtle surveys and monitoring at the Brevard County Mid-Reach project. The notice pertains to a contract extension necessitated by a project delay due to an "act of God" incident involving the assigned dredge. USACE will modify the existing contract with UCF under the authority of 10 United States Code 3204(a)(1) and Federal Acquisition Regulation 6.302-1. The procurement falls under the NAICS code 541620 for Environmental Consulting Services and will focus on surveying nesting, threatened, and endangered sea turtle species.
The primary objective of this Special Notice is to enable UCF to continue sea turtle monitoring activities for which they are the sole Marine Turtle Permit Holder in the specified Brevard County locations. The Florida Fish and Wildlife Conservation Commission (FWC) has only issued one permit for sea turtle conservation work in these areas, making UCF the exclusive contractor qualified to perform the required services. No full and open competition solicitation will be posted, and no additional contractors will be considered. The contract modification is critical for continuing environmental monitoring in the wake of project implementation delays. Potential sources interested in future similar acquisitions may contact Ms. Brittany Jackson or Mr. Dustin Furrey from USACE to discuss service capabilities. The opportunity is time-sensitive, with a response deadline of February 6, 2025, and eligibility is effectively limited to UCF due to their unique permit status and expertise in sea turtle monitoring.
Notice text
NOTICE OF INTENT TO SOLE SOURCE
The U.S. Army Corps of Engineers (USACE), Jacksonville District established a contract with The University of Central Florida (CAGE 9H673), of Orlando, FL, on a sole-source basis IAW FAR 13.106-1(b)(1), to survey nesting, threatened and endangered (T&E) sea turtle species at the project footprint of the Brevard County Mid-Reach project.
Due to an “act of God” incident occurring to the dredge assigned to the Brevard County Mid-Reach project, there is a delay in the project implementation schedule and additional monitoring is required. The Government intends to modify the existing contract and solicit The University of Central Florida on a sole-source basis under the authority of 10 United States Code 3204(a)(1) as implemented in Federal Acquisition Regulation 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
A sea turtle monitor is required for this effort and must be permitted by the state. Under Florida Statute 379.2431 (1) and Florida Administrative Code Rule 68E-1, the Florida Fish and Wildlife Conservation Commission (FWC) can only issue one permit for sea turtle conservation work if there is a need for that activity. On beaches where FWC has already issued a permit to an individual, organization, or firm to conduct nesting surveys, the FWC does not issue a second permit unless additional activities not being conducted under the standing permit exists. The University of Central Florida is the only Marine Turtle Permit Holder for the Brevard County locations identified in the Performance Work Statement (PWS). As the only Marine Turtle Permit Holder, the University of Central Florida is the only contractor qualified to perform the services in the PWS.
Based on the foregoing, the University of Central Florida is determined the only responsible source. This requirement will be solicited using other than full and open competition in accordance with FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
No solicitation will be posted for this requirement.
The applicable North American Industry Classification System (NAICS) code assigned to this procurement is 541620, Environmental Consulting Services.
