About this opportunity
The National Guard United States Property & Fiscal Office for Puerto Rico Purchasing and Contracting Division intends to award a sole source contract for architect/engineering services to perform a code and criteria review on design documents. The contract is for Puerto Rico Army National Guard Project No. 431850 Engineering Housing Maintenance Shop at Camp Santiago Joint Training Center in Salinas, Puerto Rico. The agency plans to award the contract to CH2M HILL-HDR JV under FAR 6.302-1(a)(2) authority, citing that only one or a limited number of responsible sources can satisfy the agency requirements. This special notice was posted on July 28, 2025, with a response deadline of August 11, 2025. The notice emphasizes that this is not a formal solicitation or request for competitive proposals.
The purpose of the sole source award is to leverage CH2M HILL-HDR JV's position as the Designer of Record who originally prepared the design plans and specifications for the project. The agency justifies this approach by citing tremendous performance and liability risks associated with having another A-E firm perform code and criteria review services on a project designed by a different firm, as well as the professional responsibility requirements under FAR 52.236-23. The government anticipates awarding a firm-fixed-price contract and notes that any potential updates to plans and specifications due to code changes must be performed by the original Designer of Record to maintain professional responsibility. Interested parties may express interest by providing a capabilities statement, but must demonstrate clear, compelling, and convincing evidence that competition would be advantageous to the government. The notice explicitly states that no solicitation document is available, telephone requests will not be honored, and no award will be made based on unsolicited quotations received in response to this notice.

Since there is a possibility of requiring an update to the plans and specifications due to changes to local, federal, and military codes and regulations, such changes to the design are required to be performed by the A-E Contractor and Designer of Record to maintain professional A-E responsibility over the design documents.
