About this opportunity
The United States Department of Agriculture (USDA), Farm Production and Conservation (FPAC) has issued a notice of intent to award a sole source contract for arbitrator services to a small business. This notice is specifically for arbitrator services required under the negotiated Collective Bargaining Agreement between the Kansas City Farm Service Agency and National Treasury Employees Union Chapter 264. The acquisition falls under NAICS code 541990 for All Other Professional, Scientific, and Technical Services and is classified as a Total Small Business set-aside. The agency has determined that only one source is reasonably available to meet the government's requirements, making this a sole source procurement rather than a competitive solicitation.
The purpose of this notice is to fulfill the requirements of Article 43-Arbitration, Section B of the CBA, which mandates requesting a list of five impartial arbitrators from the Federal Mediation and Conciliation Service (FMCS) for dispute resolution. The arbitrator selection process involves both parties striking names from the FMCS list alternately until only one arbitrator remains. Although this is not a competitive solicitation, interested parties who believe they can provide the required services may submit capability statements demonstrating their qualifications and ability to meet the requirements. All capability statements must be submitted in writing via email to crystal.baird@usda.gov by July 14, 2025, at 12:00 pm Central Daylight Time. The government reserves the right to determine whether to conduct a competitive procurement based on responses received, and oral communications will not be accepted in response to this notice.
