About this opportunity
The United States Section of the International Boundary and Water Commission (USIBWC) has issued a Notice of Intent to sole source a contract to Aquatic Informatics ULC for an Aquarius Software Renewal. This Special Notice, posted on January 5, 2026, with a response deadline of January 12, 2026, indicates the government's intent to award a contract without competitive bidding under simplified acquisition procedures for commercial items. The procurement falls under FAR Part 13 and FAR Part 12, utilizing the authority to solicit from a single source under FAR 13.106-1(b)(1)(i). The contract is classified under NAICS code 541511 (Custom Computer Programming Services) and PSC code 7A21 (IT and Telecom, Business Application Software). USIBWC's IT Department in El Paso, Texas has determined that a sole source award is justified for this requirement.
The primary objective of this procurement is to renew the annual Aquarius Time Series Hydrometric Workstation standalone license support and maintenance agreement. USIBWC contends that Aquatic Informatics ULC is the only source capable of providing compatible licensing, maintenance, and technical support for this proprietary software platform without incurring substantial cost duplication and unacceptable delays to operations. Interested parties have until January 12, 2026, to submit responses, though this notice explicitly states that no award will be made based on unsolicited quotations and that telephone requests will not be honored. To challenge this sole source determination, contractors must provide clear, compelling, and convincing evidence of competitive alternatives. Responses must demonstrate that other viable sources exist that can meet the government's requirements without the drawbacks cited in the justification for sole source procurement.
