About this opportunity

The Indian Health Service (IHS), a division of the Department of Health and Human Services, has issued a Notice of Intent to Award a sole source contract for urgent repairs to a Canon Medical 32-slice CT Scanner at Rosebud IHS Hospital in Rosebud, South Dakota. This acquisition is being conducted under FAR 6.302-2, Unusual and Compelling Urgency, which permits non-competitive procurement when time constraints prevent conducting a full and open competition. The contract will be awarded to Northern X-Ray Company (NXC Imaging) on a firm-fixed-price basis. The IHS determined that sole source procurement is necessary because the CT scanner is currently non-operational, creating an unacceptable risk to patient safety and the facility's ability to provide essential diagnostic imaging services. The government published this notice on April 24, 2026, with a due date of May 9, 2026, for any interested parties to submit comments or protests.

The objective of this contract is to restore the CT system to full operational status for clinical use, addressing a malfunction that occurs during angiography protocols when using Region of Interest (ROI) with SureStart functionality. The contractor must perform diagnostic evaluation, troubleshooting, necessary repairs, system calibration, functional testing, and deliver a comprehensive service report within a performance period not to exceed 60 days, with initial service expected within 1-2 weeks of award. Work will be performed on-site at Rosebud Hospital during normal business hours, and the government will provide access to the CT system and relevant operational information. Optional contract line items may be exercised for additional labor, travel, or parts based on troubleshooting findings. While this is a sole source procurement, interested parties may submit written comments or protests by the May 9, 2026 deadline, though the justification for urgent and compelling circumstances limits the typical competitive opportunity available under standard federal acquisition procedures.

AGENCY: U.S. Department of Health and Human Services (HHS), Indian Health Service (IHS)

ACTION: Notice of Intent to Award Sole Source Contract Under Unusual and Compelling Urgency

AUTHORITY: FAR 6.302-2, Unusual and Compelling Urgency; FAR Part 12, Acquisition of Commercial Products and Commercial Services

CLASSIFICATION CODE: J065 – Maintenance, Repair, and Rebuilding of Equipment – Medical, Dental, and Veterinary Equipment

NAICS CODE: 811210 – Electronic and Precision Equipment Repair and Maintenance

DESCRIPTION:

The Indian Health Service (IHS), Rosebud Service Unit, intends to award a firm-fixed-price sole source contract to Northern X-Ray Company (NXC Imaging) for the urgent repair of a Canon Medical 32-slice CT Scanner (Serial Number: KDA1282149) located at the Rosebud IHS Hospital, Rosebud, South Dakota.

This acquisition is being conducted under the authority of FAR 6.302-2, Unusual and Compelling Urgency, as implemented by HHS acquisition regulations and policies. Due to the urgent nature of this requirement, the Government does not have time to compete this requirement.

PURPOSE AND OBJECTIVE:

The purpose of this requirement is to restore the CT system to full operational status for clinical use. The CT scanner is essential for providing timely diagnostic imaging services, including emergency care, trauma evaluation, and critical diagnostic support for the patient population served by the Rosebud IHS Hospital.

JUSTIFICATION FOR URGENCY:

The CT scanner is currently non-operational, which significantly impairs the facility’s ability to provide critical diagnostic services. The lack of CT imaging capability poses a direct risk to patient health and safety by delaying diagnosis and treatment, particularly in emergency and life-threatening situations.

Delays associated with conducting a full and open competition would result in unacceptable interruptions to essential healthcare services. The Government must act immediately to restore the CT system to operational status to ensure continuity of care.

In accordance with FAR 6.302-2, only the minimum time necessary will be used to acquire these services on a sole source basis. Qualified service providers must have access to Canon Medical Systems USA, Inc. diagnostics to perform the most immediate and reliable repair services, including access to proprietary parts, technical data, and certified personnel necessary to expedite restoration.

EFFORTS TO OBTAIN COMPETITION:

This notice is being posted in accordance with FAR 5.201 to inform industry of the Government’s intent. The Government will consider any capability statements received; however, given the urgency of the requirement, responses must demonstrate the ability to provide immediate repair services without delay and with full compatibility with OEM specifications.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES.

However, any responsible source that believes it can meet the Government’s urgent requirement may submit a capability statement.

SUBMISSION INFORMATION:

Capability statements must be submitted via email within five (5) calendar days from the date of publication of this notice due to the urgent nature of this requirement. Submissions must clearly demonstrate the ability to meet the requirement immediately, including access to necessary parts, software, and qualified personnel.
