About this opportunity

The U.S. Army Corps of Engineers, Buffalo District, is announcing its intent to sole-source a $9 million contract modification to Enviro-Fix Solutions, LLC, the incumbent contractor on existing contract W912P423D0010 for the Niagara Falls Storage Site remediation, with a closing date for industry comments of June 9, 2026. This procurement is set aside for Total Small Business.

The modification will increase the existing contract capacity to complete the Balance of Plant and Groundwater Operable Unit Remedial Action, which has encountered significantly higher material quantities than originally anticipated. The contractor is already mobilized on site and nearing completion of current work. The Government asserts that awarding this work to another source would result in substantial cost duplication and unacceptable delays in completing the environmental remediation effort. The Government cites FAR 6.302-1(a)(2)(iii)(A) and (B) as its sole-source authority.

This is not a solicitation for proposals. Industry may submit comments on the Government's proposed method of accomplishing the work until the June 9, 2026 closing date.

Notice text

The U.S. Army Corps of Engineers (USACE), Buffalo District, awarded contract W912P423D0010 for the Niagara Falls Storage Site SATOC on 3 August 2023. The contractor, Enviro-Fix Solutions, LLC., is currently remediating contaminated materials under this contract.

The Government has a requirement to increase the SATOC capacity by $9,000,000. This increase will allow the Balance of Plant and Groundwater OU RA to be completed which is due to a significant increase in quantities and the current capacity is insufficient. Since the contractor is already mobilized at the project site and almost complete, the Government intends to modify the existing contract to increase the capacity, citing the authority of Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii)(A) and (B). Awarding this requirement to another source would result in substantial duplication of costs for the Government and unacceptable delays in completing the necessary environmental remediation.

This is not a request for proposal; however, industry comments can be provided until the closing date regarding the Government's proposed method of accomplishing this work.
