The U.S. Army Contracting Command - New Jersey (ACC-NJ), Picatinny Arsenal, New Jersey 07806-5000, on behalf of the Project Manager for Close Combat Systems, intends to issue a 100% Small Business Competitive Set-Aside Request for Proposal (RFP) for a single five (5) year, Firm-Fixed-Price (FFP), Indefinite Delivery, Indefinite Quantity (IDIQ) contract for the production of the M303 Blasting Demolition Kit (BDK) consisting of various components including a combination of commercial off-the-shelf items, modified commercial off-the-shelf items, and unique demolition kit fabricated items. Production of the M303 BDK will be in accordance with the Government-Owned Technical Data Package (TDP) and includes the following phases: planning, management, procurement, manufacturing, testing, inspection, Load, Assembly and Pack (LAP), packaging, and delivery of the M303 BDK to include, but not limited to, four (4) sizes of Explosively Formed Penetrators (EFP), fence piercing EFPs, multiple fragmenting EFPs, four sizes of Linear Shaped Charge (LSC) containers, three (3) sizes of conical cavity charge containers, two (2) sizes of magnets, telescoping support poles, tripods, elastic cable, special mounting brackets, cable ties, priming adapters, special purpose tape, two (2) sizes of bar and cable cutters, and training instruction sheets. The applicable NAICS code for this effort is: 332993 quote mark Ammunition (except Small Arms) Manufacturing quote mark and the FSC code is 1395 quote mark Miscellaneous Ammunition quote mark . The M303 BDK NSN is: 1375-01-612-5658. The estimated maximum contract value will be $29,800,000.00 and a guaranteed minimum of $1,143,400.00.

A Government-Owned TDP will be provided as an attachment to this upcoming RFP and is marked with a quote mark Distribution Statement D quote mark restrictive marking in which further distribution is authorized to the DoD and U.S. DoD contractors only to safeguard critical technology as determined on 12 December 2007. Other requests for this document shall be referred to the Office of the Project Manager for Close Combat Systems, ATTN: SFAE-AMO-CCS, Picatinny Arsenal, NJ 07806-5000. This TDP contains technical data whose export is restricted by the Arms Export Control Act (Title 22, U.S.C., Sec 2751, et seq.) or Export Administration Act of 1979 (Title 50, U.S.C., Appt 2401 et seq), as amended. Violations of these export laws are subject to severe criminal penalties. Disseminate in accordance with provisions of DoD Directive 5230-25.

To reserve a copy of the TDP prior to release of the RFP, offerors must provide a signed and approved DD Form 2345 Military Critical Technologies Data Agreement. If the offeror is a not based in the U.S., a copy of their approved Export License issued by the U.S. Department of State must be provided as well. After receipt of these documents, the Contract Specialist will provide an AMSTA-AR Form 1350 Technical Data Questionnaire and a completed and signed Non-Disclosure / Non-Use Agreement for completion by the offeror. When all completed documents are received by the Contract Specialist, the TDP will be sent to the offeror. Interested parties must mail / e-mail all signed and approved forms to:

PLEASE NOTE: In addition to the restricted information, the TDP also contains several quote mark Vendor Item Controlled Drawings quote mark at the component/subcomponent level. If an offeror chooses to propose an alternate source of supply for any Vendor Item Controlled Component in the TDP, the offeror will be required to demonstrate in his proposal response how the contractor will complete a Design Verification Test (DVT) for all proposed alternative sources while still meeting the Government's delivery schedule requirements. While it will be further detailed in the forthcoming RFP, the contractor will be responsible for funding and coordinating all testing.

It is anticipated that initial delivery will be required 540 days after award of the delivery order. This is inclusive of First Article Testing and Government Approval.

It is the Government's intent to solicit and award this requirement as a 100% Small Business Competitive Set-Aside. It is anticipated that this RFP will be posted to the Army Single Face to Industry website https://acquisition.army.mil/asfi/default.cfm and FedBizOpps https://www.fbo.gov/ on or about 31 January 2013. The deadline for all proposals will be forty-five (45) days after issuance of the RFP. The RFP and any resultant contract shall be subject to FAR 52.232-18, Availability of Funds.

THIS NOTICE DOES NOT CONSTITUTE A REQUEST FOR PROPOSAL (RFP). Responses to this announcement are not proposals and cannot be accepted by the Government to form a binding contract.
