About this opportunity
The U.S. Army Corps of Engineers (USACE), Seattle District has issued a Special Notice regarding a proposed contract with the Montana Department of Environmental Quality (DEQ). The notice concerns the issuance of a Montana Pollutant Discharge Elimination System (MPDES) permit for Libby Dam located in Libby, Montana. The contract will be a firm-fixed-price award, with the procurement being conducted under a non-competitive acquisition strategy authorized by Federal Acquisition Regulation (FAR) subpart 13.106-1(b)(1)(i). USACE has determined that Montana DEQ is the sole agency capable of issuing the required environmental permit for the state. The special notice follows standard procedures for synopsizing proposed contract actions as outlined in FAR subpart 5.2.
Potential contractors must demonstrate authorization to issue MPDES Permits specifically for the State of Montana to be considered eligible for this opportunity. The deadline for submitting any responses or questions is March 13, 2025, at 10:00 AM Pacific Standard Time, with electronic submissions accepted via email to the designated contracting points of contact. If no affirmative written responses are received by the specified deadline, USACE will proceed with awarding the contract without further notice. The government retains sole discretion in determining whether to open the requirement to competition based on received responses. Currently, no solicitation document is available, and all information must be provided at no cost or obligation to the government. The procurement falls under the Product Service Code (PSC) F114 for Environmental Systems Protection, specifically focusing on environmental licensing and permitting.
