The incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-69 dated August 1, 2013.  This acquisition will be processed under Simplified Acquisition Procedures (SAP).

This acquisition is being processed under the authority of FAR 13.5, "Test Program for Certain Commercial Items" and therefore will utilize simplified procedures for soliciting competition, evaluation, and award documentation and notification that comply with FAR 13.1.  The RFQ issued under the authority of the FAR 13.5 Test Program are not subject to the procedural formalities contained in Part 15 of this and higher-level regulations. For example, RFQs issued under the test program do not require a source selection plan, evaluation factors, scoring of offers, Competitive Range Determination or formal Source Selection Decision Document.

All responsible sources may submit an offer that will be considered by this agency. The North American Industry Classification System Code (NAICS) for this acquisition is 519130 (Internet Publishing and Broadcasting and Web Search Portals) and the small business size standard in number of employees is 500.

This is a fixed-price purchase order with a Base Year, plus Four Option Years.  FAR provisions and clauses that apply to this acquisition are as follows:

FAR 52.212-1, Instructions to Offerors, Commercial Items (July 2013);
FAR 52.212-2, Evaluation-Commercial Items (January 1999):
(a)  The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.  The following factors will be used to evaluate offerors in the order of importance as follows:

1.  Technical Capability of the item offered to meet the Government Requirement.
2.  Price - the Government may award a contract on the basis of the initial offer received, without discussions.
     Therefore, the initial offer should contain the offeror's best terms from a cost and price standpoint.  Award will
     be made based on factors other than price alone.

(b)  Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement.  The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.  Evaluation of options shall not obligate the Government to exercise the option(s).

(c)  A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.  Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award;

FAR 52.212-3, Offeror Representations and Certifications-Commercial Items (August 2013);
