About this opportunity
The Federal Housing Finance Agency seeks to refresh and on-ramp new law firms to an existing multiple-award IDIQ contract vehicle for legal and strategic advisory services, with Phase I submissions due September 21. FHFA anticipates awarding up to three new IDIQ contracts and reserves the right to award no new contracts under this solicitation; new awardees will compete for task orders alongside six incumbents under prior RFP FHF-26-R-0032 (Arnold & Porter Kaye Scholer LLP, Baker & Hostetler LLP, Cohen Seglias Pallas Greenhall & Furman PC, Duane Morris LLP, Maynard Nexsen P.C., and Mintz Levin Cohn Ferris Glovsky and Popeo P.C.).
This is an unrestricted procurement under NAICS 541110, Office of Lawyers. Place of performance is Washington, DC. The IDIQ ceiling is $30 million over the full term with a minimum guarantee of $1,000 per awardee. The ordering period runs from award through July 26, 2031, with potential task order performance extending beyond that date.
FHFA requires comprehensive legal services across state and federal litigation, policy counsel, regulatory guidance, and strategic advice in banking law, securities law, financial services regulation, bankruptcy, real estate, antitrust, administrative law, corporate law, insurance law, conservatorships and receiverships, insolvency, artificial intelligence, and privacy law (including FOIA and Privacy Act). Contractors must demonstrate expertise in the Housing and Economic Recovery Act of 2008 and Dodd-Frank Act. Work includes investigations, multifamily and single-family real estate matters, foreclosures, receiverships, and conservatorship matters related to Fannie Mae, Freddie Mac, and 11 Federal Home Loan Banks. All personnel must maintain active state bar membership and comply with conflict-of-interest requirements. All work requires Controlled Unclassified Information handling and NIST SP 800-171, SOC 2 Type II, ISO/IEC 27001, CMMC Level 2, or NIST Cybersecurity Framework compliance; offerors need document only one framework via independent assessment.
Evaluation employs a two-phase process: Phase I (8-page maximum) addresses legal experience; following a down-select to likely four firms, Phase II includes personnel qualifications (no price information), optional oral presentations at government discretion, pricing using provided worksheet with labor rates for five ordering periods plus three additional years, representations and certifications, and a conflict of interest mitigation plan (3-page maximum if applicable). Technical factors (legal experience weighted more heavily than personnel qualifications) are scored significantly above price; conflict of interest is rated acceptable/unacceptable. Questions to Steven Novotny, FHFA Contracting Officer, are due September 15, 2026, at 9:00 a.m. Eastern. All offerors must be registered in SAM at submission and award. Attachment E Q&A (updated September 15) clarifies that pricing requires a single hourly rate per labor category per ordering period applied to estimated hours, with a single profit percentage across all categories (default 10 percent if not provided).
