About this opportunity
The Federal Housing Finance Agency (FHFA) is seeking law firms to provide comprehensive legal and strategic advisory services through an Indefinite Delivery, Indefinite Quantity (IDIQ) contract solicitation (FHF-26-R-0032) issued on March 23, 2026, with proposals due by April 6, 2026. The services encompass litigation at state and federal levels, legal strategy oversight, regulatory advice regarding Fannie Mae, Freddie Mac, the Federal Home Loan Banks, and U.S. FinTech LLC, and expertise across multiple practice areas including banking law, securities law, financial services regulation, the Housing and Economic Recovery Act of 2008, Dodd-Frank Act requirements, bankruptcy law, real estate law, antitrust law, administrative law, corporate governance, insurance law, conservatorships and receiverships, artificial intelligence, and privacy law. Evaluation follows a two-phase process prioritizing technical merit (legal experience and personnel qualifications) significantly more than price; Phase I requires a six-page legal experience narrative and one-page geographic availability statement, with advisory down-select notifications limiting advancement to the most highly rated offerors within three weeks of the proposal deadline. Key requirements include registration in the System for Award Management (SAM), IT security compliance demonstrated through completion of a Security Assessment Questionnaire and independent assessment using NIST SP 800-171, SOC 2 Type II, ISO/IEC 27001, or equivalent standards, and submission of detailed pricing worksheets with labor rates for five ordering periods plus three extension years.
This solicitation contains no set-aside designations and represents an unrestricted commercial services acquisition under NAICS code 541110 (Offices of Lawyers). The contract features a maximum ceiling of $30,000,000 over five years (July 1, 2026 through June 30, 2031) with a minimum guarantee of $1,000 per awardee, and FHFA anticipates awarding no more than five law firms under this IDIQ vehicle. The contract period spans five ordering periods with the possibility of three additional extension years, and the contractor must submit detailed monthly invoices via the Invoice Processing Platform with labor rates broken down by eight labor categories including Senior Partner, Partner, Counsel, Senior Associate, Mid-Level Associate, Junior Associate, Staff Attorney, and Paralegal, along with travel and other direct costs. Contractors must maintain detailed timekeeping records, submit quarterly status reports with cost forecasts, obtain all necessary bar admissions and good standing certificates, and comply with strict confidentiality and conflict of interest provisions. Performance will take place in Washington, DC, with work conducted at federal courts, FHFA facilities, and contractor offices during normal business hours (Monday-Friday) as approved by the Contracting Officer's Representative, with contractor personnel limited to 40 billable hours per week for onsite FHFA work under labor-hour and time-and-materials task orders.
