About this opportunity

The Commodity Futures Trading Commission (CFTC) intends to procure a membership to the International Organization of Securities Commission (IOSCO) through a sole source procurement. The membership is critical to the CFTC's regulatory mission, enabling the agency to participate in establishing international securities regulations. The procurement will be conducted under 41 U.S.C. 3304(a)(1) and FAR 13.106-1(b)(1)(i), which allows for sole source acquisition when only one source is reasonably available. Although this is not a competitive solicitation, the government will consider written responses from responsible sources that demonstrate capability to fulfill the requirement. Responses must be received by January 6, 2025, and oral communications will not be accepted.

The pre-solicitation notice indicates no specific set-aside designation for this procurement. The contract will have a performance period of one year, focusing on a professional organization membership in the NAICS category 813920 (Professional Organizations) with a Product Service Code of U005 for education/training membership fees. While no specific award value is disclosed, the procurement is for a single-source membership with IOSCO, which is recognized as the global standard setter for the securities sector. The CFTC has identified IOSCO as the sole provider of the required membership, and any responses will only be considered to determine whether a competitive procurement might be more appropriate, with the final determination at the CFTC's sole discretion.

Notice text

The Commodity Futures Trading Commission (CFTC) intends to procure a membership to the International Organization of Securities Commission (IOSCO) on a sole source basis. The anticipated contract will have a period of performance of one (1) year.  IOSCO is the international body that brings together the world’s securities regulators and is recognized as the global standard setter for the securities sector.  IOSCO develops, implements and promotes adherence to internationally recognized standards for securities regulation.  CFTC’s membership to IOSCO is critical to the Commission’s regulatory mission, enabling countries to assist in establishing regulations.  The Government intends to procure this requirement under 41 U.S.C. §3304 (a)(1) and FAR 13.106-1(b)(1)(i) which states "the circumstances of the contract action deem only one source reasonably available." The identified vendor is the sole provider of the membership required by CFTC.  Therefore, this vendor is the only responsible source identified as reasonably available that will satisfy the agency requirements.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS and a solicitation will not be issued.  However, the Government will consider responses from all responsible sources received by the date and time identified on this posting.  Written responses must include sufficient information to establish capability to fulfill the requirement.  Oral communications are not acceptable in response to this notice.  Any responses received will only be considered for the purposes of determining whether to conduct a competitive procurement in lieu of the sole source described in this notice, and such determination shall be made at the sole discretion of the CFTC.
