About this opportunity

The U.S. Army Corps of Engineers, Buffalo District, issued a sole-source intent notice on February 12, 2026, for an estimated $1.1 million modification to contract W912P425CA026 with Morrish Wallace Construction, Inc. d/b/a Ryba Marine Construction Co. for additional maintenance dredging in Buffalo Harbor, with industry comments due by February 22, 2026. This action is a total small business set-aside.

The modification arises from a vessel grounding in fall 2025 that created a hazardous condition in the federal navigation channel, requiring increased dredging quantities outside the scope of the existing contract. USACE justifies sole-source award under FAR 6.302-1(c)(2)(i) and (ii) on grounds that the incumbent contractor will already be mobilized at the project site beginning June 16, 2026. A competitive procurement would require 90–120 days and create substantial duplication of mobilization and demobilization costs; delay would leave the navigation channel hazardous through the current operational season. The work is classified under NAICS 237990 and PSC Y1PZ (Construction of Other Non-Building Facilities). USACE conducted a fair and reasonable pricing determination by comparing the contractor's proposal against base contract rates and an independent government estimate. No capability statements or expressions of interest were received during the posting period.

Notice text

The U.S. Army Corps of Engineers (USACE), Buffalo District, awarded contract W912P425CA026 for Buffalo Harbor maintenance dredging on 24 September 2025. The contractor, Morrish Wallace Construction, Inc. d/b/a Ryba Marine Construction Co., is currently scheduled to begin dredging operations on 16 June 2026 in Buffalo Harbor under this contract.

The Government has a requirement to increase the dredging quantities due to a vessel grounding in the fall of 2025; however, this additional work is considered outside the scope of the existing contract. Since the contractor will already be mobilized at the project site, the Government intends to modify the existing contract to include this additional dredging on a sole-source basis, citing the authority of Federal Acquisition Regulation (FAR) 6.302-1(c)(2)(i) and (ii). Awarding this requirement to another source would result in substantial duplication of costs for the Government and unacceptable delays in completing the necessary dredging.

This is not a request for proposal; however, industry comments can be provided until the closing date regarding the Government's proposed method of accomplishing this work.
