About this opportunity
The U.S. Army Corps of Engineers, Portland District, has issued a Special Notice announcing its intent to negotiate a sole-source contract with the Confederated Tribes and Bands of the Yakama Nation for fall Chinook acclimation and release services at Prosser Hatchery. This notice, posted on August 28, 2025, with responses due by September 12, 2025, pertains to a supply contract under NAICS code 112511 (Finfish Farming and Fish Hatcheries) with a size standard of $3.75 million. The contract involves providing facilities and services for the annual acclimation, long-term rearing, and release of up to 600,000 sub-yearling upriver bright fall Chinook juveniles. The Prosser Hatchery is located downstream of Prosser Dam on the Yakima River, which flows into the Columbia River near Richland, Washington. This procurement falls under the Product Service Code 8820 for Live Animals, Not Raised for Food.
The primary objective of this contract is to fulfill the Army Corps of Engineers' mitigation obligations for The Dalles and John Day Dams through the acclimation and release of juvenile fall Chinook salmon. The Corps has determined that Prosser Hatchery is uniquely qualified for this work due to its appropriate water temperature, adequate rearing pond space, and availability during required months for successful fish acclimation. No other facilities exist in or near the lower Yakima River that possess both the capability to acclimate these fish and are not already committed to similar USACE projects. The sole-source justification is based on the Yakama Nation's exclusive ownership and control of the underlying land, facilities, and equipment at Prosser Hatchery, as they do not permit other contractors to utilize these specialized facilities. Regional fisheries experts from the National Marine Fisheries Service, U.S. Fish and Wildlife Service, and USACE have concurred that Prosser Hatchery represents the optimal solution for this critical environmental mitigation program.

Synopsis:
This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) Subpart 5.2 “Synopses of Proposed Contract Actions.”
The Army Corps of Engineers intends to negotiate the sole-source award of a new supply contract with the Confederated Tribes and Bands of the Yakama Nation (Yakama Nation). All requirements necessary will be provided for the annual acclimation, long-term rearing, and release of up to 600,000 thousand sub-yearling upriver bright (URB) fall Chinook juveniles at Prosser Hatchery. This fish egg collection satisfies a portion of USACE’s mission in fulfilling mitigation obligations for The Dalles and John Day Dams.
Prosser Hatchery is situated just downstream of Prosser Dam at river kilometer 75 of the Yakima River. The Yakima River feeds into the Columbia River near Richland, Washington, above Zone 6. Prosser Hatchery possesses the appropriate water temperature, rearing pond space and availability during the required months to acclimate and release the subject fall Chinook juveniles into the Yakima River. No other acclimation and release facilities exist in, or near, the lower Yakima River that are 1) capable of acclimating these fish, and 2) not already in use by USACE for similar purposes.
The underlying land, facilities and equipment at Prosser Hatchery are under the ownership of the Yakama Nation. Therefore, Yakama Nation has sole control and use of the facilities at Prosser Hatchery and does not permit other contractors to utilize these facilities. Regional fisheries experts from NMFS, USFWS and USACE agree that Prosser Hatchery is the only reasonable location to perform these specific rearing and release activities.
The Delivery date will be 30 June 2026. Funding will be provided in the fiscal year the purchase order is being awarded.
Pursuant to 10 U.S.C. § 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 13.106 -1(b), only one responsible source and no other vendor will satisfy agency requirements.
A SOLICITATION WILL NOT BE POSTED
