The Health and Human Services Office of Inspector General intends to make a Firm Fixed Price sole source award in the amount of approximately $32,800.00 to acquire necessary expert services for nephrology Services. The award will be made to:
Derek Michael Fine, M.D.
DUNS Number: 080121764
In accordance with FAR 6.302-3, "Industrial mobilization; engineering, developmental, or research capability; or expert services".
OCIG seeks to contract with a physician specializing in nephrology (the "medical expert") to provide expert medical record review, consulting, and possible expert testimony services related to an investigation of and potential litigation against a nephrologist (the "target provider") under the Civil Monetary Penalties Law, 42 U.S.C. § 1320a-7a.
The objective of the contract is to acquire necessary services of the medical expert to support an investigation and possible litigation related to the issuance of civil money penalties against or exclusion of the target provider who presented or caused to be presented claims for medical or other items or services that the target provider knew or should have known were not provided as claimed, or were false or fraudulent, or were not medically necessary. The medical expert will review medical records and billing information provided by OCIG and consult about the results of his analysis of those records with attorneys from OCIG. If necessary, the medical expert may be required to generate a report outlining the conclusions of his medical record review, testify at an administrative hearing, and provide post-hearing consultation and other support to OCIG attorneys.
Within the last nine months, OCIG researched physicians specializing in nephrology in the United States and compiled a list of seven physicians. OCIG contacted three physicians from that list. Dr. Fine was ultimately chosen because (1) he has the requisite medical expertise in nephrology-the area at issue in OCIG's investigation-and the target provider whom OCIG is investigating specializes in nephrology; (2) he has experience testifying in civil cases; (3) his curriculum vitae demonstrated both clinical experience and academic experience at an elite medical school; and (4) his fee estimate appeared reasonable when compared to other physicians OCIG spoke with and previous experts OCIG has hired within the last five years.
