About this opportunity

The United States Army Corps of Engineers, Engineering Research and Development Center–Construction Engineering Research Laboratory (ERDC-CERL) intends to solicit renewal of an annual subscription to the Westlaw Enflex EDGE environmental regulatory database, with responses due July 17, 2026. ERDC-CERL has determined that West Publishing Corporation (Westlaw) is the sole responsible source and will award this acquisition pursuant to FAR 12.102(a) (noncompetitive procedures for commercial items).

Work will be performed at ERDC-CERL. The requirement covers a base year and four option years. ERDC-CERL has used Enflex for regulatory research for over 28 years, with internal updating processes closely integrated with Enflex's state environmental regulatory updates. The database originated from the CELDS system, which was developed through DoD-funded research, and operates consistent with CERL's own regulatory update methodology. ERDC-CERL's search for alternative regulatory information sources has yielded no substitute. Enflex EDGE provides full American legal reports, GAO legislative history, on-the-fly comparison of statute and regulation versions across their historical record, and tracking of agency-submitted regulation change requests under review nationwide. No competing source consolidates this information set in a single database. Certain regulatory updates are available exclusively through Westlaw.

This pre-solicitation notice does not obligate the Government to award a contract. No dollar value, specific contract vehicle, or additional terms are disclosed.

Notice text

The United States Army Corps of Engineers (USACE) Engineering Research and Development Center- Construction Engineering Research Laboratory (ERDC-CERL) has a requirement for the renewal of their annual subscription to the Westlaw Enflex regulatory database. This requirement will include a base year and four option years.

ERDC-CERL has determined that only one responsible source will satisfy agency requirements and intends to award this acquisition in accordance with RFO FAR 12.102(a) to West Publishing Corporation (Westlaw) as the company is the only provider of the Enflex EDGE environmental regulatory database. West Publishing Corporation (Westlaw) is the sole producer/provider of the Enflex EDGE environmental regulatory database. ERDC-CERL has utilized Enflex for its regulatory research needs for over 28 years, with our internal updating process closely interwoven with the way Enflex updates the state environmental regulations.  Enflex itself is based on the CELDS database, which was originally developed by DoD funded research, and also operates in a fashion based on how CERL does their regulatory updates.  CERL researchers have looked for alternative sources of regulatory updates over the years but have yet to find any similar alternative or substitute. Also, there are certain regulatory updates that are only available through Westlaw.

Westlaw’s online database includes contents such as full American legal reports and GAO legislative history.  In addition, Westlaw has recently added features that are helpful to research needs.  For example, the EDGE features allowing on-the-fly comparisons of previous versions of any statute or regulation throughout its history.  EDGE also tracks requests for regulation changes that have been submitted by agencies nationwide and are under review.  No other sources include all of this information in one consolidated database.

This is not a request for proposal and in no way obligates the Government to award any contract.

The associated North American Classification System (NAICS) code is 513199, All Other Publishers, which has a size standard of 1,000 employees. This is not a small business set aside. Any interested party that believes they can fulfil this requirement should submit a capability statement to be reviewed. All submissions will be considered, however there is no guarantee that submissions in response to this notice will in any way alter the Government’s acquisition strategy.

The anticipated award date for this action is 24 August 2026.
