About this opportunity
The Indian Health Service (IHS), under the Department of Health and Human Services, published this Special Notice on March 9, 2026, regarding the intent to award two non-competitive, sole source contracts for electricity utility services in Toppenish, Washington and White Swan, Washington. The notice covers electrical services for multiple IHS facilities, including an annex building, main clinic, administrative buildings, and a satellite dental clinic. This is not a competitive solicitation but rather a notice of intent to award contracts to Pacific Power and Yakama Power as sole source providers. The contracts fall under Federal Acquisition Regulation authorities including FAR Part 12 (Commercial Items), FAR Part 37.101 (Non-Personal Services Contracts), and FAR Part 41 (Acquisition of Utility Services). The primary purpose stated is to ensure continuity of utility services to prevent interruptions that could impact direct patient care operations.
The objective of this sole source acquisition is to maintain uninterrupted electrical service to critical healthcare facilities operated by the IHS Yakama Service Unit. Interested parties must submit written evidence by 5:00 PM Eastern Daylight Time on March 23, 2026, demonstrating that competition would be advantageous to the Government; without such a response, the contracts will be awarded without further notice. The notice specifies that no competitive quotes or proposals will be solicited, as both Pacific Power and Yakama Power are identified as the sole companies uniquely authorized to provide the required utility services to their respective service areas. There are no specific eligibility criteria for contractors to challenge this award, as the determination has already been made that these vendors are the only qualified providers. Interested parties should recognize that this abbreviated comment period ends on March 23, 2026, and any submission must present compelling justification for reconsidering the sole source determination.
