About this opportunity

NASA's Kennedy Space Center issued a Justification for an Exception to Fair Opportunity on January 23, 2026, for a firm-fixed-price task order awarded to Merrick & Company under the Southeast Regional Architect and Engineer (SERAE) multiple-award contract for design services related to modifying the Vehicle Assembly Building High Bay 3 to support the Space Launch System Phase 3 at Kennedy Space Center. The justification invokes FAR 16.505(b)(2)(i)(C) as the exception basis, citing that this order represents a logical follow-on to Merrick's prior design work on the same project under contract NNK17CA04B, valued at $5,488,805.47, and that Merrick possesses unique qualifications as the original design firm and Engineer of Record for the specialized platform and insert structure design work required. The estimated task order value is $1,049,125 with a performance period of 245 days from award, and the justification emphasizes that procuring from an alternative contractor would result in approximately 1,000 to 1,500 additional labor hours, exceed $200,000 in additional design recertification costs, and create potential schedule delays of two to three months. The government conducted fair opportunity evaluation among nine SERAE contractors, with Merrick selected as the top-ranked firm based on technical qualifications, and price reasonableness will be ensured through verification of labor hour rates and comprehensive cost analysis.
