The purpose of this notice is to inform the public of NNSY's intent to award a sole source contract to E. H. Wachs, the sole manufacturer of the Omega Seal Cutting Machine, under the statutory authority of 41 U.S.C. 1901 and FAR Subpart 13.5. The contract has a due date of September 17, 2024. E. H. Wachs is the only eligible contractor as the original equipment manufacturer who owns the proprietary technology and designs for the cutting machines and wheels. No other bids will be accepted, and the government will not pay for any information received in response to this notice.

INTENT TO SOLE SOURCE – E. H. WACHS  

THE NOTICE IS PUBLISHED FOR INFORMATION PURPOSES ONLY AND IS NOT A REQUEST FOR COMPETITIVE PROPOSALS.

The Norfolk Naval Shipyard (NNSY), Portsmouth, VA intends to award a firm-fixed-price (FFP) contract to E. H. Wachs, on a sole source basis, for 7 custom Omega Seal Cutting Machines (E. H. Wachs Ref No. 24-034-5000-00) and 280 Chip-less Cutting Wheels (E. H. Wachs Ref No. 24-034-0700-00), utilizing the statutory authority under 41 U.S.C. 1901 as implemented by Federal Acquisition Regulation (FAR) Subpart 13.5 – Simplified Procedures for Certain Commercial Products and Commercial Services.  NNSY will solicit and negotiate directly with E. H. Wachs.  This notice of intent is not a request for competitive proposals. It is not a solicitation or request for offers. However, all responsible sources may submit a capability statement which will be considered by the agency.  The capability statement must be submitted in writing and must contain clear and convincing evidence that competition of this requirement would be advantageous to the Government.  A determination by the Government not to compete this effort is solely within the discretion of the Government. The Government will not pay for any information that is received. Any information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.  No other bids will be accepted.  No other manufacturers will be considered.

The associated North American Industry Classification System (NAICS) Code for this supply is 332216, with a size standard of 600 employees and PSC Code 5130.

E. H. Wachs is the sole equipment manufacturer of the 12.74” Omega Seal Cutting Machine which is a purpose-built system for the U.S. Navy. The entire Omega Seal Cutting Machine, including all the components, and its final working arrangement makes use of E. H. Wachs patented, and company protected technologies. The Omega Seal Cutting Machine design, drawings, images, specifications, plans, working arrangement and any other associated engineering and manufacturing information “whole or in part” is owned and controlled by E. H. Wachs, who is the Original Equipment Manufacturer (OEM). There are no authorized distributors or technical representative for the OEM.
