This announcement constitutes an Award Notice by  38 CONS /LGCC The Government has awarded a sole source contract to provide Active, Top Secret (TS) Clearance court reporter services specifically trained in stenography including the stenographer hardware to support a classified Government Accountability Office (GAO) bid protest hearing during the estimated time period of 07-15 July 2016.     38 CONS/LGCC has executed by means of other than full and open competition, sole source contract to TAD PGS, Inc. dba Alderson Court Reporting GS, to provide TS court reporter services from  07-15 July 2016  The contract number for this award is FA8773-16-C-0015.  The award of this contract is necessary to provide support to this critical acquisition program. The authority permitting other than full and open competition is 10 USC 2304(c)(1), as implemented in FAR 6.302-1(a)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as this contract is under unique security, performance, and time constraints to support the time-critical classified GAO bid protest hearing.  Market research has shown that no other source meets the time lines or requirements mandated by the GAO.  This Award Notice does not constitute a Request for Proposal nor does the issuance restrict the Government to a single acquisition approach. The Government will not pay for any information received in response to this notice nor will the Government compensate a respondent for any costs incurred in developing the information provided to 38 CONS/LGCc.  An AFSPC Ombudsman is available to consider and facilitate the resolution from offerors, potential offerors, and others for this acquisition.  Before consulting the Ombudsman, concerned parties should first address their concerns, issues and disagreements, and/or recommendation to the listed Contracting Officer for resolution.  The Ombudsman hears concerns about specific issues in acquisitions from industry or Government personnel, communicates those concerns to AFPSC leadership, and assists in the resolution of those concerns.  The Ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes, nor does the Ombudsman diminish the authority of the program manager, contracting officer, or source selection official.  When approached with an issue or query, the Ombudsman independently assesses the situation and provides a response or initiates a resolution, and when requested, will maintain confidentiality as the source of the inquiry.  The Ombudsman, Senior Contracting Official at AFICA/KS, , can be contacted at: 150 Vandenburg Street, Peterson AFB, CO 80914-1105, Telephone: 719-554-5300 E-mail: afica.ks.wf@us.af.mil.

38 CONS/LGCC intends to solicit and negotiate with only one source under the authority of FAR 6.302-1 this solicitation is for Court Reporting Services, where the court reporter must hold a Top Secret Sensitive Compartmented Information (TS/SCI) clearance. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract based upon responses to market research conducted by the Contracting Officer and SAF/AQC.  This notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The North American Industry Classification System (NAICS) code proposed for the requirement is 541611. The size standard for NAICS 541611 is 1500 employees. The government is interested in all small businesses including (8(a), Historically Underutilized Business Zone, or Service Disabled Veteran Owned Small Businesses that are interested in performing this requirement. The government requests interested parties submit  their technical and pricing proposal, a brief description of their company's business size (i.e. annual revenues and employee size), business status (i.e., 8(a), Historically Underutilized Business Zone, or Service Disabled Veteran Owned Small Businesses, small business) anticipated teaming arrangements, and a description of similar services offered to the Government and to commercial customers. Any responses involving teaming agreements should delineate between the work that will be accomplished by the prime and the work accomplished by the teaming partners. Award will be made using Lowest Price Technically Acceptable in accordance with FAR Par 13. All questions or comments should be directed electronically to the POCs listed above; no other format will be considered or accepted. All information pertaining to this acquisition, including technical questions and answers shall be provided to the Contracting Officer ONLY to ensure equal distribution of information to interested parties. All prospective offerors interested in submitting proposals must have a Commercial and Government Entity (CAGE) code and must be registered with System for Award Management (SAM) as prescribed in DFARS 252.204-7004 in order to receive award. SAM may be obtained at www.sam.gov. Additionally, all offerors must complete the registration package on the Federal Business Opportunities website, which places them on the solicitation source list. An AFSPC Ombudsman has been appointed to consider and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. Before consulting the Ombudsman, concerned parties should first address their concerns, issues, disagreements, and recommendations to the Contracting Officer for resolution. In addition, AFFARS Clause 5352-9101, Ombudsman, will be included in this acquisition's solicitation and contract.
