About this opportunity

The U.S. Army Corps of Engineers, Baltimore District, is conducting market research for the Alvin Bush Dam Rock Wall Stabilization Project in Clinton County, Pennsylvania, which involves installing anchored, reinforced concrete liner walls along the spillway and outlet channel to stabilize deteriorating rock faces. The project scope includes rock excavation, concrete wall installation with rock anchors, construction of a concrete ditch, headwall, access road, and safety access stairs. The primary purpose of this Sources Sought Notice is to assess whether requiring a Project Labor Agreement (PLA) would substantially reduce the number of potential offerors and prevent adequate competition at fair and reasonable prices, following the recent rescission of Class Deviation 2025-O0002 that had removed mandatory PLA requirements for large-scale construction projects over $35 million. The Baltimore District is seeking vendor feedback through a detailed 10-question request for information to determine if an exception to PLA requirements should be pursued. Interested vendors must submit their responses by close of business on July 10, 2025, via email to designated contract specialists.

This opportunity is classified under NAICS code 237990 for Other Heavy and Civil Engineering Construction with Product Service Code Y1NZ for Construction of Other Utilities, and no set-aside designation has been applied. The notice does not identify any incumbent contractors or provide specific award values or budget ranges, though the reference to PLA requirements for projects exceeding $35 million suggests this is a substantial infrastructure investment. No specific timeline for project completion or quantity details are provided in the market research phase, as this is not a formal solicitation but rather an information-gathering effort to inform the government's contracting approach. The Baltimore District emphasizes that this Sources Sought Notice does not guarantee a future contract opportunity and is solely focused on understanding market conditions and potential contractor capabilities for this critical dam infrastructure stabilization project.

Notice text

On 02 June 2025, the Principal Director of the Defense Pricing, Contracting, and Acquisition Policy rescinded Class Deviation 2025-O0002 and its Revision 1 which removed the mandatory requirement to include Project Labor Agreements in all large-scale construction projects greater than $35M.  By rescinding the class deviation, contracting officers are required to follow the requirements for project labor agreements as implemented at Federal Acquisition Regulation (FAR) 22.5.  Accordingly, the Baltimore District is performing market research to assess market conditions to determine if an exception to the PLA requirements should be pursued. Specifically, the Baltimore District is requesting specific information as whether the inclusion of the PLA requirement would ‘substantially reduce the number of potential offerors to such a degree that adequate competition at a fair and reasonable price could not be achieved’ (FAR 22.504(d)(1)(ii))
