About this opportunity
The US Patent and Trademark Office (USPTO) has issued a Special Notice announcing its intent to sole source arbitration services to Keith Greenberg of Rockville, Maryland. This notice pertains to procurement ACQ-25-1929 under NAICS code 541990 for All Other Professional, Scientific, and Technical Services. The USPTO's Office of General Law requires these services as part of a standing arbitration panel that was jointly selected by parties to hear grievances. The agency is exempt from the Competition in Contracting Act under the Patent and Trademark Office Efficiency Act and will utilize alternative competition methods outlined in the Patent and Trademark Office Acquisition Guidelines. The estimated contract period is twelve months with an anticipated award date of September 8, 2025.
The primary objective of this sole source procurement is to retain continuity and efficiency in ongoing arbitration proceedings where Mr. Greenberg has already been agreed upon by both parties. Contractors interested in this opportunity should note the response deadline of September 2, 2025, though this notice is not a request for competitive proposals. The sole source justification is based on Mr. Greenberg being the only known qualified source already accepted by the parties, and substituting arbitrators at this stage would risk inconsistency and undermine process integrity. The procurement falls under FAR 6.302-3(b)(3)(ii), which specifically allows other than full and open competition for neutral persons facilitating alternative dispute resolution processes. The notice emphasizes that maintaining the current arbitrator serves the government's best interests and aligns with USPTO's statutory authority to complete the arbitration matter efficiently.

PTAG Part 6.1.1 Synopsis – Non-Competitive
The Office of General Law (OGL) provides general litigation and advisory services on matters concerning the administration and management of the USPTO. The parties have jointly selected four arbitrators, including Mr. Greenberg, to serve on a standing panel to hear grievances brought by the parties.
For this procurement, the USPTO is exempt from the Competition in Contracting Act (CICA) as the subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act 35 U.S.C. 2(b)(4)(A). The full text is located here: https://federalregister.gov/a/2013-24316.
The USPTO intends to negotiate and award a Purchase Order for Arbitration Services under NAICS Code 541990- All Other Professional, Scientific, And Technical Services to Keith Greenberg, 6117 Calwood Way, Rockville, MD 20852-3551 for an estimated period of performance comprised of twelve (12) months. The anticipated award date is September 8, 2025.
In this instance, Mr. Greenberg is the only known qualified source since he has already been agreed to by both parties. Accordingly, for reasons of continuity, efficiency, and fairness to the parties, it is essential that this arbitrator be retained to complete the matter. Substitution at this stage would not only risk inconsistency and duplication of effort, but would also undermine the integrity of the process. It is in the best interest of the Government and consistent with USPTO’s statutory authority to proceed with this arbitrator through the conclusion of this case. Moreover, FAR 6.302-3(b)(3)(ii) specifically allows for the use of other than full and open competition to procure, “A neutral person, e.g., mediators or arbitrators, to facilitate the resolution of issues in an alternative dispute resolution process.”
This notice of intent is not a request for competitive proposals nor will a solicitation be issued to the public.
