SOLICITATION No. YA1323-18-TC-0001

1. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested at this time.

2. This solicitation is issued as Request for Proposal (RFP) Number YA1323-18-TC-0001

3. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-99.

4. The Census Bureau intends to issue single contract to obtain all or any of the required Commercial Data elements as described though Section 6 of the Solicitation.

The NAICS code and small business size standard for this acquisition is 511140 Directory and Mailing List Publishers – Small Business Size standard is $20.5 million dollars. This solicitation is not set-aside for Small Businesses.

5.1 PRICE SCHEDULE

The fixed price of the contract is [To Be Determined before award]. The prices set forth below shall apply for payment purposes for all items acquired under this contract.

6. DESCRIPTION OF COMMERCIAL DATA FILE REQUIREMENTS

6.1 Background

The Census Bureau conducts research and production work using administrative records data to enhance numerous programs and products. The Census Bureau enters into agreements with data providers, including federal, state, and private entities, to acquire data files. These data are used to support planning and conducting future decennial censuses, current surveys such as the American Community Survey (ACS), and other Census Bureau demographic and economic research and production work. The Census Bureau will use the data acquired in the contract to continue to carry out the aforementioned production work that is underway as well as continue our research to find new uses for the data we obtain.

6.2 Specific Requirements

The Contractor shall provide commercial data file(s) as specified below to support the work described above.

6.2.1 The Contractor shall provide commercial data file(s) as specified below to support the work described above.

6.2.2 The Contractor shall provide readily available datasets from public or commercial records to be matched and comingled with AHS, ACS, and RHFS housing units. The vintage of the records in the databases shall be the most current available.

6.2.3 Offerors choosing to submit a proposal(s) for one or more aspects of this RFP shall offer only national coverage (50 U.S. States and Washington, DC) for each data file proposed.

6.2.4 The Census Bureau wants the ability to use the commercial data file upon receipt without additional processing at Census. The contractor shall deliver the commercial data as a single file, or as few files as practical, on schedule, and data elements shall consist of no errors 98% of the time.

6.2.5 The contractor shall deliver the preliminary commercial data file within 30 days of a date agreed upon after the contract award. The contractor shall ensure the file contains the data elements defined in Table 1 in Section 5.1 Price Schedule, and contained in the sample data file submitted during the proposal process.

6.2.6 The contractor shall ensure the most current information as of the time of delivery.

6.3 Overall database requirements (metadata, universe, format, and delivery)

6.3.1 General Commercial Data File Requirements: The contractor shall provide metadata and vintage information for each commercial data file delivered to the Census Bureau. All commercial data files shall be delivered in ACSII format or other agreed upon format.

The contractor shall deliver to the Census Bureau via an agreed upon secure file transfer method (ex. Web2 upload, Accellion) on an agreed-to schedule.

6.3.2 Metadata: The contractor shall deliver a data dictionary or description of data fields with valid values with each delivery. The data dictionary shall denote how often each value for each variable is populated along with any other relevant information.

6.3.3 Vintage: The contractor shall deliver the most current information in each commercial data file delivery.

6.3.4 Commercial Data File Format: The contractor shall deliver the commercial data file in a single fixed-length ACSII format via a secure file transfer protocol (SFTP). The Census Bureau has a system in place to receive this type of file transfer.

6.3.5 All written deliverables shall be prepared in Microsoft Word format.

6.4 The scope of work is separated for each of the nine sets of data elements.

7 Master Address list for each parcel Data elements shall include, at a minimum, a list of valid addresses at that tax parcel, including unit level designations.

8 Vacancy/occupied status Data elements shall include, at a minimum, an indicator of the vacancy status for each address, including details on what sources informed this status

9 Enhanced Characteristics List Data elements shall include, at a minimum, any files which utilize modeling of various data sets to generate characteristics of housing units

6.4.1 Public records – this requirement includes data available through public records. The government is intending to purchase these records for the base period. It includes, at a minimum, information about property tax, deeds, mortgages, assignments & releases, pre-foreclosure and foreclosure variables. It includes, at a minimum, year built, owner occupied status, mortgage amount, mortgage interest rate, and payoff amount. Additional data elements gathered from public records are welcome.

6.4.2 Modeled Housing Value - this requirement includes, at a minimum, the current estimated property value. There may be multiple models used to estimate the value of a

RFP No. YA1323-18-TC-0001 7 property. If there are multiple models used to estimate the value of a property, we are interested in each one. Additional related data elements, such as date value estimate was produced and confidence score for value estimate, are welcome

6.4.3 Open Liens - this requirement includes, at a minimum, information from open liens modeling, and characteristics of open liens such as lien position and amount remaining.

The government is intending to purchase these records for the base period. Additional data elements related to these addresses, such as first lien amount and first lien date, are welcome.

6.4.4 Multiple Listing Service data – this requirement includes, at a minimum, information typically submitted by property sellers to their local MLS affiliate. The government is intending to purchase these records for the base period. It includes information like number of bedrooms, description, list price, date of listing, HOA/COA dues (if applicable), number of bathrooms.

6.4.5 Parcel Boundaries data – this requirement includes the actual spatial boundaries of parcels. Additional related data elements are welcome.

6.4.6 Homeowners Association/Condominium Owners Association listing data - this requirement includes, at a minimum, the status of whether an address is a member of a HOA/COA, as well as the dues to that association for that address if that is available.

Additional data elements related to homeowners/condominium associations, such as the association name, are welcome.

6.4.7 Master Address list for each parcel – this requirement includes, at a minimum, a list of valid addresses at that tax parcel, including unit level designations. Additional data elements related to these addresses are welcome.

6.4.8 Vacancy/occupied status - this requirement includes, at a minimum, an indicator of the vacancy status for each address, including details on what sources informed this status.

Additional data elements related to the vacancy status of addresses are welcome.

6.4.9 Enhanced Characteristics List - this requirement includes any files which utilize modeling of various data sets to generate characteristics of housing units.

6.5 Technical Support

The Contractor shall provide technical support regarding file structure and delivery, file contents and completeness, and data consistency over time. The contractor shall work to resolve technical issues within 48 business hours of being notified.

6.6 Intended Data Uses

The usage of the commercial data will meet Census Bureau Disclosure Avoidance standards. The Census Bureau will not release any identifiable information obtained through this contract. The

Census Bureau will not use the data for marketing or compliance purposes. The Census Bureau will not resell the data.

6.7 Data Usage Rights

The Census Bureau will commingle the commercial data obtained through this contract with existing Census Bureau data. The Census Bureau will not segregate vendors’ commercial data from Census Bureau or other data, so the data will in effect become the property of the Census Bureau.

The contractor shall provide the Census Bureau the data usage rights to retain and use the purchased commercial data files indefinitely, with all financial consideration proposed as part of the initial pricing.

The contractor shall provide data usage rights to the data to allow the Census Bureau to share with other Federal Agencies and publish papers on topics that used the commercial data files in the course of research. Any other federal agencies with access to the commercial data files obtained through this contract will treat it just as the Census Bureau would – they will not release any identifiable information obtained through this contract, will not use the data for marketing or compliance purposes, resell the data, or publish or release comparisons of purchased data.

6.8 Data Retention

The Census Bureau will retain the commercial data under this contract indefinitely. By delivering the commercial database after contract award, the contractor gives the Census Bureau the right to retain and use the purchased data files indefinitely, with all financial consideration proposed as part of the initial pricing.

6.9 Licensing Agreements

The Census Bureau recognizes and accepts that each Offeror may wish to enter into licensing agreements with the Government to indicate the terms and conditions for use of their data.

However, consideration must be given to the following terms and conditions due to the nature of Federal Contracting (See Section 13.9 “1352.239-70 Software License Addendum”. The Offeror/Contractor accepts these limitations as part of entering into this contract:

(a) “Automatic Renewal” – The Government will not agree with this condition – due to the Anti-Deficiency Act (31 U.S.C. §1341(a)).

(b) “Choice of Law” – The agreement between the Contractor and the Government shall be governed and construed with applicable federal law and regulations.

(c) “Indemnification” of vendor by Government – The Government will not agree to this condition – due to the Anti-Deficiency Act (31 U.S.C. §1341(a)).

(d) Vendor’s assertion of right to control litigation in defense of claim of patent infringement

– The following language is acceptable:

“In the event of a claim or suit is brought against LICENSOR or LISENCEE [or similarly defined party designations] for any patent or copyright infringement relating to this license in which the United States is named as a party, the LICENSEE shall be represented by the U.S. Department of Justice which shall control the litigation or any settlement agreement; however, the LICENSOR shall be allowed reasonable participation in the defense or settlement of such claim or suit.”

(e) Payment terms and late fees/penalties – These terms must be in compliance with FAR 52.232-25 – Prompt Payment (JAN 2017).

(f) Requirement for Binding Arbitration of Disputes – The Government will not agree with this condition, disputes will be settled in accordance with FAR processes and guidelines.

(g) Audit terms that require vendor access to Government information, documentation, or systems – This requirement must be conditioned as follows: “…to the maximum extent permissible under federal law and regulation.”

7. DELIVERY AND ACCEPTANCE

7.1 Delivery Periods:

The period of performance of this contract is from the September 30, 2018 through September 29, 2019 with four -12 month option periods.

(a) The option periods that may be exercised are as follows:

7.4 Quality Standards

The Contractor shall provide products and deliverables that meet the following criteria:

Quality Assurance/Acceptance – Quality measures, as set forth below, will be applied to each Work Product and Deliverable:

Accuracy – Work products and deliverables shall be accurate in presentation and technical content and be developed in accordance with “Census Bureau Statistical Quality Standard B2: Acquiring and Using Administrative Records”. Data elements shall consist of no errors 98% of the time.

Completeness – Work products and deliverables shall be comprehensive and entirely developed.

Clarity – Work products and deliverables shall be clear and concise.

Timeliness – Work products and deliverables shall be generated on or before specified and/or mutually agreed to due dates or in accordance with a later scheduled date, should a later scheduled date be mutually agreed to by the Contractor and the Contracting Officer’s Representative (COR) and/or Task Manager.

Format – Work products and deliverables shall be submitted in the format specified in the contract.

Inspection and Acceptance Criteria – Final inspection and acceptance of all work products will be performed on-site. Final inspection and acceptance of all work performed and deliverables will occur upon CO signature.

7.5 Performance Measures and Reporting

The Contractor shall meet or exceed the requirements stated above. The COR will measure performance through close monitoring. The Contractor must fully document and explain any deviations from the stated objectives. The Contractor’s services shall be considered successful if performance provides the expected outcomes within the performance standards:

8. INSTRUCTIONS TO OFFERORS

FAR Provision 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (JAN 2017), applies to this acquisition, as tailored below:

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition is 511140 and appears in Section 4 of the solicitation. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show—

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) “Remit to” address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR

(9) The Offeror Shall submit a description of the operation schedule related to data acquisition and database updates. The U.S. Census Brueau wishes to determine how quickly parcel data are updated for each of the datasets.

(10) To assist in the evaluation of submitted proposals, the offeror shall prepare and submit the following metrics describing their data. These figures should be disaggregated by each state in the United States, including Washington, DC.

The count of the number of unique parcels with a mortgage amount in 2017, The number of unique parcels with an estimated or reported first lein amount in

2017, The number of unique parcels that have one or more MLS listings in 2017, and The number of unique parcels in each stat with a modeled housing value in 2017.

(11) A Sample Data File, (see specific instructions in Section (d) below); Also see Attachment A, Census Bureau Sample Data Transfer

(12) Proposed Terms and Conditions for Licensing Agreement (See Section 6.9 “Licensing agreements” for Government requirements).

(12) Complete Pricing Tables 1 - 3 provided through Section 5 for all proposed data elements during each of the contract delivery periods identified under Section 7.1, inclusive of any discount terms. Tables 4-6 are optional and do not affect the determination if they are not available.

Please note that all pricing information shall be submitted as a separate document from the technical proposal, although it may be included in the same transmittal e-mail.

(13) The Offeror shall provide Past Performance references from a minimum of three (3) previous or current customers who have extensive experience with the data provided by the Offeror. The customers should have received similar services within the past three (3) years.

(16) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(17) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for

30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Sample Data File. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(1) For evaluation purposes, the Offeror shall submit sample commercial data files containing the data elements described in RFP Section 6.4 for California, Oklahoma, and North Carolina for each of the nine files for which the offeror intends to submit proposals.

(2) The submitted data file(s) shall be as current as possible. Offerors shall identify the date when the file was most recently updated.

(3) The submitted data files must include accompanying metadata (6.3.2) and Vintage (6.3.3).

(4) The Offeror shall submit the sample database, no later than, August 31, 2018 5:00 PM EST PM Eastern Standard Time and in accordance to the submission instructions in Attachment A to this solicitation.

(5) The Offeror shall provide technical support regarding file structure and delivery, file contents and completeness, and data consistency over time.

(6) The sample data file shall be submitted at no expense to the Government. By submitting the sample data file in response to this solicitation, the Offeror gives the Government the right to keep and use the data file during the evaluation period.

(7) Non-Selected Offerors – Pre-Award sample data files will not be distributed beyond the core team of Government officials that are responsible for analyzing the test data.

Sample data files provided by Offerors that are not selected for award will be destroyed within 30 days of contract award.

(8) Selected Offerors – Pre-Award Sample data files provided in accordance with RFP

Section 8(d) by the Offerors that subsequently receive award will be protected under the terms agreed upon under RFP Section 6.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately in accordance with the evaluation factors described in RFP Section 9.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 2:00 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint.

However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in 5.1 Price Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(j) Unique entity identifier. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database.) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “Unique Entity Identifier” followed by the unique entity identifier that identifies the Offeror’s name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer.

(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.

(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(4) A summary of the rationale for award;

(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.

8.1 As part of the written proposal, the Offeror shall provide information as to when the best and most complete information will be available for delivery to the Census Bureau.

9. EVALUATION

FAR Provision 52.212-2, EVALUATION – COMMERCIAL ITEMS (OCT 2014), applies to this acquisition, as tailored below:

Factors 1, 2 and 3 are Technical Factors. Factor 1 (Technical Capability) is more important than Factor 2 (Data Licensing Terms and Conditions). Factor 2 is more important than Factor 3 (Past Performance). Factor 3 is the least important of the technical factors. Factor 4 (Price) will be evaluated separately. Factors 1 through 3, when combined, are significantly more important than price. This will be a best value determination.

Factor 1: Technical Capability of the item offered to meet all Government requirements;

The Government will evaluate the Offeror’s proposed technical approach to assess the database capability to comply with all requirements defined in Sections 6 and 7.

For the technical evaluation, we will compare the sample commercial data files to Census Bureau data of known coverage and quality to gauge the coverage and quality of the sample database. We expect all commercial data elements and fields as outlined in Section 6.4 to be filled with accurate data; missing responses shall be explained. This evaluation will specifically analyze the coverage and quality of required data elements.

Any additional data elements provided would be evaluated as well as we are able to, and will be considered favorably if they are of value to the government.

Technical Documentation: The Offeror must demonstrate the ability to produce and deliver the commercial data files with the specified data file contents and metadata, on time and in the correct format. The technical support must be timely and reliable, and offer satisfactory resolution.

Factor 2: Data Licensing Terms & Usage Terms The Census Bureau needs to commingle and retain the data acquired under this contract indefinitely. Any proposed Data Licensing Agreement and Usage Terms that are considered not in the best interest for the Government according to the terms described in section 6, may result in non-consideration for award.

Factor 3: Past Performance Evaluation of past performance will allow the Government to determine whether the Offeror consistently delivered quality services in a timely manner. Past performance will be evaluated for data sold by the Offeror during the last three (3) years consistent with the size, scope and complexity of this solicitation. The Government may contact references provided as well as other relevant individuals.

Factor 4: Price

(a) The price tables in Section 5.1 identify pricing for data elements that are “Required” at the time of award. The prices for the data elements identified as “Required” in Tables 1, 2 and 3, must be proposed in the Offeror’s price proposal in order for the government to evaluate. The total evaluated price will consist of all pricing provided for the Base and all Option Periods in tables 1, 2 and 3, and will be the basis of the price evaluation.

(b) The data elements that are identified as “Optional” in tables 4, 5, and 6, are not required at the time of award. The Offeror shall provide prices for all optional data elements proposed. These tables are not included in the total evaluated price.

(c) The Contractor may not charge the Government for any items acquired under this contract at any prices other than those specified in Section 5.1.

(d) Evaluation of options shall not obligate the Government to exercise the option(s).

The Government will also evaluate on the basis of accuracy, completeness, and reasonableness.
