HANDOUT6A– SOLE SOURCE

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(SOLE OR SINGLE SOURCE)

In accordance with the authority granted under FAR Part 13, this request for a noncompetitive acquisition is hereby submitted for consideration for acquisition approval.

1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTI NG

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING

APPROVED:

This request is for an extended warranty and service contract on a Rad Source RS 2400 X-ray irradiator that was purchased new in 2011 and whose current warranty and service contract will expire in 20 . The X-ray irradiator is an important asset of the California tation and is used to conduct research on sterilization doses for pest insects for possible sterile insect program development. The purpose of purchasing the extended warranty and service contract is to keep the unit operational to continue this research and to keep equipment operational in the event an emergency program implementing rapid deployment of SIT response is needed. The unit needs regular maintenance to service the proprietary X-ray tubes and the PCL.

Service contract proposal will provide the following:

I. Renew the full warranty* on the RS 2400

a. Access to a back-up power supply that is maintained at Rad Source's facility.

b. Annual Preventative Maintenance visit

3. A DESCRIPTION OF THE SUPPLIES, EQUIPMENT, OR SERVICES

REQUIRED TO MEET AGENCY NEEDS (INCLUDING THE ESTIMATED

VALUE OF THE ACQUISITION INCLUSIVE OF OPTIONS):

The extended warranty will provide protection for additional problems arising in the new system which can be extremely costly to resolve. Since the system had two major problems in the past, this agreement will allow service/repair to the irradiator that will far exceed costs to repair without a warranty. Extending the manufacturer's warranty will likely save the government a large amount of money in future repair costs for parts and labor.

4. IDENTIFICATION OF THE STATUATORY AUTHORITY PERMITTING

NONCOMPETITIVE ACQUISITIONS:

The statutory authority is 41 U.S.C. 253( c )(1) OR 253( c )(2)

The property or services needed by the executive agency are available from only one responsible source and no other type of property or services will satisfy the needs of the executive agency

5. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR' S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE

OF THE AUTHORITY CITED:

This is a manufacturer's warranty for service for our RS 2400 X-Ray system which is not available from other companies.

6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS

PRACTICABLE, INCLUDING WHETHER A NOTICE WAS, OR WILL BE,

PUBLICIZED AS REQUIRED BY FEDERAL ACQUISITION REGULATION

(FAR) SUBPART 5.2, AND IF NOT, WHICH EXCEPTION UNDER FAR 5.202

APPLIES:

To my knowledge, no other companies offer manufacturer's warranties covering parts and labor for the system in question, and since it is a Rad Source, only the manufacturer's service technicians have adequate experience, knowledge, and expertise about the intricacies of this system and its inner workings. Also, Rad Source offers immediate 24-hour support, can ship replacement parts overnight, and send an expert service technician with very little notice.

7. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE, AND THE BASIS FORTHAT DETERMIN ATION:

This procurement was previously advertised with a Notice of Intent and there were no vendors who could provide the work needed. The pricing is fair and reasonable based on Market Research and previous industry knowledge.

8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (FAR

PART 10) AND THE RESULTS, OR AN EXPLANATION OF THE REASON

MARKET RESEARCH WAS NOT PERFORMED:

The market research was completed following previous procurement, the incumbent vendor is the manufacturer of the X-Ray unit.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL

AN D OPEN COMPETITION - FAR 6.303-2(a)(9):

10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN

INTEREST IN THE ACQUISITON:

During the previous acquisition planning phase for this project a notice was posted on SAM.gov with no interested parties. A notice will be posted in SAM.gov within 14 days of contract award per FAR 13.5.

11. A STATEMENT OF THE ACTIONS, IF ANY. THE AGENCY MAY TAKE

TO REMOVE OR OVERCOME AN Y BARRIERS TO COMPETITION

BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES,

EQUIPMENT, OR SERVICES REQUIRED:

An effort was made to overcome barriers by previously posting the NOI.
