Justification and Approval for Other Than Full and
Open Competition
1. Contracting Activity: 118 Wing, Mission Support Contracting (MSC) 240 Knapp Blvd, Berry Field Air
National Guard (ANG) Base, TN 37217.
2. Description of Action: This justification is prepared for a new firm fixed price construction contract to renovate 12,400 square to building 740 located at the 118th Wing, Nashville ANG Base, Nashville, TN. This project includes for one brand name component along with the sole source for the installation of the component. The project is solicited under Invitation for Bid (IFB) Number W50S97-20-B-0001. ANG Minor
Construction and Facilities Sustainment, Restoration and Modernization funds are appropriated for this action.
3. Description of Supplies/Services: As part of the renovation the contractor is required to:
a. Procure the Automated Logic Corporation (ALC) energy management system (EMS) software and hardware components. This system is a single source solution for the EMS.
b. Procure the services of the regional authorized vendor for ALC for the installation of the ALC EMS.
This requirement consists of supplying and installing an Automated Logic Corporation EMS with required direct digital controls (DDC) to be utilized by the 118th Civil Engineering Squadron, Nashville ANG base, Nashville, TN. This system must be compatible with the existing EMS (ALC) that is already in place in
Nashville at the ANG Base.
4. Authority Cited: The statutory authority permitting Other than Full and Open Competition is 10 U.S.C.
2304(c)(1) as implemented by FAR 6.203-1, Only one responsible source and no other supplies or services will satisfy agency requirements. It is likely that any other source would result in substantial duplication of cost to the Government that will not be recovered through competition.
5. Reason for Authority Cited:
a. Automated Logic EMS is the system currently utilized at all buildings at the Nashville ANG Base and consequently in the existing building 740 which is being altered as part of this project. This system is proprietary and does not communicate with open source direct digital controls. It is not possible to substitute any other software or programmed hardware to communicate with this existing system. In addition, this system is proven reliable and has unique graphics and computer routines.
The 118th Civil Engineer operations and maintenance staff already possess the requisite training in this system, and the introduction of any other system would require additional training or personnel to operate. The estimate to purchase the equipment is $4,000.00
b. Automated Logic is locally installed by The Comfort Group. This vendor is very familiar with the base operating system and current controls in building 740. They are the only authorized installer in the Nashville area. If this product line is distributed and/or installed by another company, Automated
Logic voids the warranty on the equipment and installation of the equipment including the existing system that is maintained by The Comfort Group. The estimate to install the equipment is approximately $15,400.00
6. Efforts to Obtain Competition: The solicitation for the construction of the Squadron Operations Building will be a competitive Invitation for Bid (IFB) set aside for small businesses. The brand name components represent a small portion, less than 1% of the overall construction project that is being competed.
7. Actions to Increase Competition: This J&A will be posted to Beta SAM.GOV s with the solicitation and potential suppliers may have the opportunity to propose compatible products for consideration.
8. Market Research: The following market research techniques were conducted within the previous 12 months:
a. The 118th Civil Engineer Squadron has utilized the services of The Comfort Group several times over the past 12 months and has good historical cost data for their services. The estimate for these services is based on 10% of the total estimated cost of the HVAC installation for this project which has historically been a price point on projects of this size.
b. No additional market research was conducted for the Automated Logic EMS. This document will be posted to FedBizOpps during the solicitation of the construction project. Any firms will have the opportunity to provide a substitute for this equipment for consideration.
9. Interested Sources: To date, no other sources have written to express an interest. There are no known alternative systems that are fully compatible with the aforementioned systems based upon lessons learned and experience of the 118th Air National Guard.
10. Other Facts: The following facts are identified:
a. Nashville ANG Base Civil Engineering has set the base standard for these system for 10 existing buildings. It is in the best interest of the Government to procure the Automate Logic brand energy management system for new facilities being built so that there will not be a duplication of cost by having to replace the EMS with an ALC system at a later date.
b. The maintenance and repair training for these systems is brand name specific, and it is necessary to keep the systems the same for communicating with each other, as allow for spare parts compatibility and reduce storage and efficient training requirements. With multiple brand names, the end user of the facility would need to be trained on how to utilize, maintain, and repair all the different systems.
The costs over the lifecycle of the facility would also be increased for service and annual maintenance.
c. The Facilities Management spare parts inventory will remain manageable with all systems of the specified brand name. For each different brand name specified, a different software system would be required, resulting in additional costs to the Government for the maintenance of each system. By using the aforementioned systems listed, communication and compatibility issues will be alleviated and result in a fully integrated and functioning base wide system. Having the same brand name on all required systems would be the most cost effective solution for the government.
d. The selection of the Automated Logic product line ensures facility energy efficiency and the seamless integration and communication of Nashville ANG Base facilities while providing reduced maintenance costs over the lifecycle of the facility, training costs & requirements for end users, response time in emergency situations, and spare parts stock costs for the Tennessee Air National
Guard.
