About this file
This document is a detailed contract specification for epoxy paint striping issued by the Montana Department of Transportation (MDT) for the Wolf Point Area. The project involves applying epoxy pavement markings across multiple routes in northeastern Montana, specifically on highways N-22, N-1, P-31, and P-32, covering approximately 159 miles of roadway. The contract requires striping 3,499 gallons of white 4" stripe, 1,193 gallons of yellow 4" stripe, 14,753 square feet of symbols/words, and 13,701 linear feet of yellow curb marking. Work is scheduled to commence after July 1, 2025, and must be completed by October 3, 2025, with some sections located on the Fort Peck Reservation.
The project is federally funded and subject to Build America, Buy America (BABA) requirements, mandating that construction materials be manufactured in the United States. The epoxy paint must meet specific technical specifications, including color requirements, durability standards, and environmental safety limits for metals like antimony, arsenic, and lead. Contractors must use Montana Type 2 glass beads, apply markings at a 20 mil thickness, and follow strict surface preparation guidelines. Payment will be based on unit prices per gallon of stripe and square foot of symbols, with potential price reductions for materials not meeting exact specifications. The contract emphasizes detailed traffic control procedures, surface preparation techniques, and compliance with Montana Department of Transportation standard specifications.

1.3.4. Build America, Buy America (baba) [106] (ADDED 12-08-22)
Furnish construction materials manufactured in the United States. Manufacturing processes for the construction material must occur in the United States. Manufacturing processes are defined as the final manufacturing process and the process immediately preceding the final manufacturing process. Construction materials include articles, materials, or supplies that are or consist primarily of:
| • | Non-ferrous metals. |
| • | Plastic and polymer-based products (including polyvinylchloride, composite building materials, and polymers used in fiber optic cables). |
| • | Glass. |
| • | Lumber, and |
| • | Drywall. |
Construction materials exclude cement and cementitious materials, aggregates including stone, sand, or gravel, or aggregate binding agents (e.g., asphalt binder) or additives (e.g., polymer modifiers and admixtures).
Treat items that consist of two or more construction materials that have been combined through a manufacturing process, and items that include at least one construction material combined with a material that is not listed through a manufacturing process, as manufactured products. Manufactured products that do not contain steel or iron are exempt until further notice.
Buy America preference applies to articles, materials, and supplies that are consumed in, incorporated into, or affixed to a project. It does not apply to tools, equipment, and supplies brought to the construction site and removed at or before the completion of the project (e.g., temporary aluminum scaffolding). Buy America preference does not apply to equipment and furnishings that are used at or within the finished infrastructure project but are not permanently affixed to the structure (e.g., movable chairs, desks, or computer equipment used at or within the project but are not integral or permanently affixed to a structure).
Submit Form MDT-MAT-407 “Manufacturer’s Certificate of Compliance” for every material identified as a construction material in the Department’s Materials Manual Section MT 601 furnished to the project. Do not incorporate construction materials into the project until all required documentation is submitted to the Department. Ensure that suppliers and manufacturers understand the BABA and contract requirements to supply the required documentation.
The Department will not accept items installed until all supporting documentation has been reviewed and is found to be in accordance with the contract requirements. Insufficient or unavailable documentation or documentation showing products to contain construction materials of foreign origin are grounds for removal and replacement at the contractor’s expense.
The Department has designated which materials are considered “construction materials” and will be required to meet the new BABA regulations by their respective 9-digit material codes in section MT 601 of the Montana Materials Manual. However, the Department recognizes there will be situations where a product or material may not fit the designation indicated in section MT 601. In these cases, submit documentation demonstrating or justifying the supplier or manufacturer’s position their specific item has been misclassified to the Project Manager at least 10 business days in advance of installation. The Department, in conjunction with FHWA, will review the submitted documentation and make a determination as to how that specific product or material will be classified. These determinations will be final and will require the appropriate necessary documentation as defined above.
Form MDT-MAT-407 is available at the following web page:
https://www.mdt.mt.gov/publications/forms/const_forms.shtml
1.4. ADDITIONAL WORK
Additional work is considered to be any work outside the scope of the designated route or beginning and ending mileposts that are outlined in this contract.
1.4.1. Any additional work performed under this provision shall be the same type of work for which the contract was awarded and will only apply if the Contractor is set up and operational. Subsequently, no additional compensation for the bid items "mobilization" and “traffic control” will be allowed. The additional work provision will not apply if the Contractor has to be mobilized to a new location.
1.4.2. The Maintenance Chief reserves the right to make, in writing, at any time during the work, such changes in quantities and such alterations in the work as are necessary to satisfactorily complete the project. Such changes in quantities and alterations shall not invalidate the Contract nor release the surety, and the Contractor agrees to perform the work as altered.
If additional work or changes in quantity significantly change the scope of work, an adjustment will be made to the contract. A significant change is defined as an increase in excess of 125% or a decrease below 75% of the original contract quantity item. Any adjustment for an increase in quantity shall apply only to that portion in excess of 125% of the original contract item quantity, or in case of a decrease below 75%, to the actual amount of work performed.
1.4.3. Payment for work under this provision will be at the unit price bid for work for which the contract was awarded. Any additional work must connect with either end of each specified project site. Any additional work must be for the same type as specified in the original contract.
1.4.4. Additional work can only be performed after prior approval of the Helena Maintenance Division Administrator or the designee and written addenda from the Procurement Services Section. This addenda must be in the form of a Purchase Order Adjustment. The addenda will include the following information:

The Maintenance Chief may request changes to the schedule to best meet the needs of the Department as long as the changes do not impact the sequence of work or designated contract date to the point it changes the terms of the contract as bid. Once the schedule is approved by the Maintenance Chief and concurred with by the Contractor, subsequent changes to the schedule must be approved in writing by both the Maintenance Chief and the Contractor.
1.5.3. If the Contractor is unable to complete the work by the designated contract date for reasons beyond his control, he may request a change to the designated contract date from the Maintenance Chief. Such request shall be in writing and shall state the reasons for the request. The request must be received a minimum of five (5) working days prior to the designated completion date. The Maintenance Chief will review the request and will provide the Contractor with a written response indicating approval, in which case a new designated contract date will be provided, or disapproval with appropriate reasons. If the Contractor disagrees with the assessment of liquidated damages, the Contractor must follow the contract specification entitled “Claims for Adjustments and Disputes”.
A disagreement regarding the assessment of liquidated damages arises when the Contractor receives notice of the assessment.
1.5.4. In the event the Department increases quantities outside the scope of work; additional day(s) will be added to extend the designated contract date by using the following formulas:

Shadowing is defined as a word/ and or symbol having multiple visible letter(s) from previous applications. Removal will be by heavy grind or by a method approved in writing by the Maintenance Chief or their designee. Acceptance of any words and/or symbols that do not conform to current detailed drawings must be approved in advance, in writing by the Maintenance Chief or their designee.
1.7.4.4. Yellow Curb Marking. Prior to application, clean the surfaces following the paint manufacturer’s recommendations. Remove all scale, dirt, grease, loose paint, and other foreign material by sand blasting with air, high-pressure water or mechanically grinding, sanding, scraping or brushing. All removed and excess pavement marking material is required to be picked up and disposed of prior to striping and the opening of the work zone to public traffic. Waste material becomes the property of the Contractor. Dispose of waste material according to current applicable solid waste laws and regulations.
1.7.4.5. Epoxy Application for Curbs. Apply epoxy to the tops and traffic sides of curbs at restricted parking locations as specified. Apply one uniform coat of epoxy paint to the tops and traffic sides of all island curbs, median curbs, and other similar curbs as shown in the Contract or as directed by the Inspector on site.
1.7.4.6. Reflective Glass Beads on Epoxy Curb. This work is the application of reflective glass beads to yellow curb marking epoxy. Provide reflective glass beads meeting the requirements of Subsection 714.08. Apply at least eight (8) lbs./gallon of glass beads to the top and traffic sides of all island curbs, median curbs, and other similar curbs immediately following the application of the epoxy. Evenly distribute beads across the curb surface.
Glass beads are not measured for payment. Include the cost of the glass beads and application in the unit bid price for Yellow Curb Marking.
1.7.4.7. Concrete Surfaces. Grind the concrete surfaces as specified for asphalt surfaces. For safety reasons, the Contractor is required to pick up excess beads from the roadway.
1.7.4.8. Words, Symbols and Hash Marks. Match the existing pavement marking configuration (stencil) as noted in the Specifications for Work. If Contractor cannot match existing markings, refer to 2.7.4.3. For safety reasons, excess beads must be removed prior to opening to traffic.
1.7.5. Removal Limits Meet the following requirements
1.7.5.1. Grind no more than one (1) inch wider on each side of the existing stripe.
1.7.5.2. Grind no more than four (4) inches from the beginning or end of the existing stripe.
1.7.6. Sequence of Operations
1.7.6.1. Light Grind. For light grind work Contractor must stripe all roads as stated below.
Contractor must stripe all roads within three (3) calendar days after grinding. If the grinding operation is more than three (3) calendar days ahead of the striping operation, the Contractor must provide and install temporary pavement markings at no cost to the Department.
1.7.6.2. Heavy Grind. For heavy grind work contractor must stripe all roads as stated below
1.7.6.2.1. Centerline

If the Contractor does not replace the centerline pavement markings the same day grinding was performed, the Department reserves the right to hire another contractor or have Department crews stripe the area at the Contractor’s expense.
1.7.6.2.2. Edge Line
If new pavement markings are not applied within three (3) calendar days of grinding, then the Contractor must provide and install temporary pavement markings at no cost to the Department.
If the Contractor does not replace the edge line pavement markings within three (3) calendar days of grinding, the Department reserves the right to hire another contractor or have Department crews stripe the area at the Contractor’s expense.
1.7.6.2.3. Temporary Pavement Markings
Temporary pavement marking tabs may be offset no more than six inches from the new line. Place three tabs spaced two (2) feet apart, every 40 feet for temporary centerline and lane line markings. Install yellow or white tabs, matching the final line color. All tabs must be removed prior to final pavement marking application.
If a temporary waterborne stripe is applied, a light grind is required prior to placing the epoxy paint.
1.7.6.2.4. Option
If the weather does not permit the Contractor to apply temporary pavement markings, the Contractor will be required to put up signs stating “no center stripe” according to the MUTCD.
1.7.6.3. Pavement Marking Application
Test Stripe. On startup of the first day of pavement marking application, apply a minimum of 1,000 feet of stripe and a maximum of 5,280 feet for each color being applied. The Department will test for thickness, color, and line width. The Department will check striping totalizer vs. Department DMI (Distance Measuring Instrument).
Based on the evaluation results of the test stripe, make necessary adjustments to the striping equipment. Perform other evaluation test stripes when requested.
1.7.6.3.1. Application Instructions
Apply a 20 mil +/- 2 mil (0.508 mm +/- 0.051 mm) thin wet film immediately followed by applying at least 25 lbs./gallon (3kg/L) of glass beads to the epoxy. Mil thickness in excess of 20 will not be paid for. Apply the markings to within + ¼ inch (6 mm) of the specified width.
Match the existing pavement marking configuration unless noted otherwise in the Specifications for Work.
Immediately terminate striping application if the applied stripe(s) are less than 18 mils thick. All pavement marking applications less than 18 mils must be removed and replaced with striping meeting the contract requirements at Contractor expense. All pavement marking applications greater than 22 mils may be subject to remove and replace at Contractor expense. Correct all deficient striping before continuing with the remaining striping work. The Project Manager will identify deficient stripe thickness by comparing the tank quantities measured and used against length, width and application rate of the applied stripe.
Apply enough glass beads to the uncured epoxy so that the beads completely fill the epoxy film from the film-pavement interface to the top surface of the film to the extent that there are loose beads on the surface of the uncured line. Apply Montana Type 2 glass beads at a rate of at least 25 pounds (3 kg) of beads per gallon (liter) of epoxy applied in a manner that provides uniformly retro-reflective lines.
Use only reflective glass beads that meet all of the Department’s requirements and are on the qualified products list (QPL). Glass Beads must meet the requirements for AASHTO M 247 Type 2 beads referenced in the Montana Standard Specifications for Road and Bridge Construction and subsequent supplemental specifications (714.08). 1. PARTIAL PAYMENT
Partial payment for work completed and accepted may be made at the discretion of the Maintenance Chief. Partial payment can be made only if there are 2 or more specific locations on an individual contract. No partial payment will be made on any “lump sum” bid items. No payment will be made for any route or site that has remove and replace markings until the measures have been corrected.
1.12.1. Materials Delivered and Stockpiled at Project Site
Materials delivered and stockpiled at the project site or other location approved by the Project Manager may be considered for partial payment, if the following requirements are met:
1.12.1.1. The material meets the contract requirements.
1.12.1.2. The material is a manufactured end product or a fully fabricated product.
1.12.1.3. Material is stored to prevent damage and theft, without obstructing or impeding the traveling public. Department Inspectors must always have access to the inventory sheets and the stockpiles to verify quantities. MDT is not responsible for lost, stolen, or damaged materials.
1.12.1.4. A written request including the quantity for which partial payment is requested, the length of time the material is to be stored, the location for material stored, and sufficient detail to justify the costs. Project Manager shall approve all requests prior to delivery and partial payment.
1.12.1.5. Clearly identify the project number, location, designation, lot or batch number and the entire inventory on these sheets. Keep each project’s stockpiled material separated from stockpiles belonging to other projects. Only use stockpiled material for the designated project.
1.12.1.6. Partial payment made for material on hand does not constitute acceptance of the material.
1.12.1.7. If stored material is lost, stolen, or damaged, the material’s value will be deducted from the subsequent estimate or estimates.
1.12.1.8. Partial payment for stored material, acceptance of the materials to be stored, or approval of the storage method does not relieve the Contractor’s responsibility for all materials and work upon which partial payments have been made or the restoration of any damaged work. The partial payments are not a waiver by the Department of any other contract provisions or of its rights to require fulfillment of all contract terms.
1.12.1.9. Partial payment will be made for the invoice price, or for the manufacturing costs incurred by the Contractor. Partial payment for stockpiled materials will not exceed the contract unit price or the amount justified to the Project Manager. Partial payment will not exceed 30% of the total line-item cost for white and yellow gallons of paint. Maximum partial payment for materials in storage will be based on quantities that will be measured for partial payment. Submit stockpiled materials requests using the same unit of measure as the contract item.
1.12.2. Winter Weather Conditions
1.12.2.1. If the project is not completed (which includes replacement of defective pavement markings) by the required completion date and the Contractor is unable continue striping due to winter weather shutdown, then a partial payment may be made. Any partial payment made at this time will deduct any liquidated damages that accrued prior to the winter shutdown and any anticipated liquidated damages based on the earliest possible spring completion. Partial payments will not be made until the spring schedule has been submitted and approved by the Maintenance Chief.
1.12.2.2. All striping operations will cease on November 16th and cannot commence again until April 15th without the prior written consent of the Maintenance Chief. Liquidated damages will stop on November 16th and restart on April 15th, unless the Contractor has permission to stripe during this time period. If the Contractor has exceeded the required completion date, and stripes during this time, liquidated damages will be charged for days worked.
1.12.2.3. If the Maintenance Chief determines that it is in the best interest of the Department to cease operations prior to November 16th, a written notice will be given to the Contractor. Liquidated damages will cease on the date stated in the written notification and restart on April 15th. If the Contractor does not agree with this shutdown, Contractor may appeal this to the Procurement Services Section Supervisor.
1.12.2.4. The appeal must be in writing and state the reason(s) why the Contractor does not agree with the Maintenance Chief. The Procurement Services Section Supervisor’s decision will be made in writing to the Contractor and Maintenance Chief and will be final.
1.12.2.5. If the Contractor has not exceeded the required completion date and is unable to continue striping due to winter weather shutdown, then a partial payment may be made for those specific locations that were striped prior to the Contractor ceasing striping operations for the season.
1.12.2.6. If the Contractor was unable to complete a location due to winter weather shutdown, then a partial payment may be made for striping completed and accepted prior to the Contractor ceasing striping operations for the season.
1.12.2.7. The Contractor must provide a spring completion schedule to the Maintenance Chief for approval. Partial payments will not be made until the schedule has been submitted and approved by the Maintenance Chief.
1.12.2.8. Any areas that have received a light or heavy grind must be striped prior to making any partial payment.
1.13. ENVIRONMENTAL SPECIAL PROVISIONS
1.13.1. Protection of Storm Water Drainage System and Compliance with Local Permit Requirements [208] (Revised 11-14-24M)
This project is located within an area designated by the Montana Department of Environmental Quality (DEQ) as a regulated MS4. Contact the Wolf Point Maintenance Chief, 200 E Highway 25, Wolf Point, MT, phone 406-942-2316 to determine if additional requirements are in place for construction storm water discharges that would affect this project.
Review Subsection 208.03.1(C) for more information.
1.13.2. Storm Water Permitting Requirements under the Montana Pollutant Discharge Elimination System (MPDES) [208] (Revised 8-10-23)
A. Description. The DEQ regulates storm water discharges under the MPDES program. If the bid package contains blank erosion control plans, a construction storm water discharge permit authorization will be required. If not, a storm water discharge permit authorization may be required for this project depending on Contractor’s operations. Sum the disturbance area (as defined by DEQ) identified in the contract with the area of disturbance caused by contractor operations to determine if the permit acreage threshold is exceeded. Contractor operations can include, but are not limited to, the following support activities: staging areas, access roads, material storage areas, temporary concrete, or asphalt batch plants, borrow areas, areas used for fill placement, etc. If the summed disturbance area is one acre or more, use the DEQ authorization to discharge under the MPDES General Permit for Storm Water Discharges Associated with Construction Activity (General Permit) for this project. In order to facilitate permit transfer, separate NOI packages are required for areas within the right-of-way and areas outside of the right-of-way. A NOI package includes a Notice of Intent, with a topographic map, a SWPPP, the erosion control plans, sage grouse consultation letter, if applicable, and supporting documentation.
Blank Erosion Control Plans, and a topographic map, are provided with the plans if the plans include greater than 1 acre of disturbance. Complete the erosion control plans as required by the general permit. Complete the SWPPP using DEQ’s most current SWPPP Form.
B. Materials. Follow the requirements described in the Department’s Erosion and Sediment Control Best Management Practices Manual (December 2016). Rescind Section 208 detailed drawings. Submit to the Project Manager for review and acceptance BMPs proposed for use that are not included in the Manual.
C. Construction Requirements.
1. MPDES Permit Required.
a) Submit one NOI package and the associated fees to DEQ for ground disturbance areas shown in the plans or within the right-of-way. For ground disturbance areas shown in the plans and any other areas within the right-of-way where Contractor activities causing ground disturbance are planned, the Contractor is the sole permittee until construction is complete and the General Permit is transferred to the Department or another entity.
The Department is not responsible for delays caused by incomplete or inaccurate submittals by the Contractor.
Comply with the requirements of the General Permit and implement the SWPPP. Provide an electronic copy of the NOI Package submitted to DEQ and confirmation for receipt of a complete NOI Package from DEQ to the Project Manager prior to conducting any ground disturbance activities.
Do not begin construction activities until the required copy of the NOI Package submitted to DEQ and confirmation for receipt of a complete NOI Package from DEQ is received by the Project Manager.
b) Furnish and install public signage as required by the General Permit. Include the cost of the required sign(s) in the Temporary Erosion Control Lump Sum bid item. Submit a separate NOI package and the associated fees to DEQ for ground disturbance and support activity areas outside the right-of-way and not shown in the plans. Contractor furnished material sources, staging areas, plant sites, or any other Contractor caused ground disturbance outside the right-of-way and not shown in the plans, are the Contractor's responsibility and must be submitted under a separate NOI package from the ground disturbance within the right-of-way. For all support activities outside the right-of-way which are not part of a larger commercial operation serving multiple unrelated construction activities and will not continue operation beyond the completion of the contracted road construction activity, a notice of intent package must be submitted to DEQ to obtain an authorization under the General Permit. Sand and gravel borrow area operations, gravel pits, and/or concrete batch plants that will continue operation beyond the completion of the contracted road project, are part of a larger commercial operation, or serving multiple unrelated construction activities, must obtain permit coverage under the Multi-Sector General Permit for Storm Water Discharges Associated with Industrial Activity (MSGP) regardless of acreage size of the activity if the activity does not already have MSGP authorization. The Contractor is the sole permittee until stabilization is complete and the General Permit is terminated or transferred to another entity. The Department is not responsible for delays caused by incomplete or inaccurate submittals to DEQ by the Contractor.
Provide copies of all NOI Packages submitted to DEQ and confirmations for receipt of complete NOI Packages from DEQ to the Project Manager prior to conducting any ground disturbance activities.
Be responsible for all temporary erosion, sediment, and pollution prevention controls for Contractor furnished material sources, staging areas, plant sites, or any other Contractor caused ground disturbance outside the right-of-way and not shown in the plans.
c) Complete and document all inspections in accordance with the requirements of the General Permit. Use DEQ’s most current self-inspection form available online at: https://deq.mt.gov/files/Water/WQInfo/Documents/WPBForms/2023-Attachment-B-MTR100000.pdf. Provide a copy of all inspection reports to the Project Manager within 7 calendar days of the inspection.
Report potential noncompliance in accordance with applicable regulations, guidance, and permit conditions. Submit to the Project Manager within 7 calendar days of sending or receiving all correspondence to or from regulatory agencies regarding potential noncompliance or violations.
The temporary erosion and sediment control measures and devices to prevent pollution and control sediment transport and soil erosion will be inspected as part of the final inspection to ensure they are maintained and functioning properly. Do not transfer or terminate the General Permit coverage until the BMPs are inspected and accepted and all records required under the permit, including inspection and monitoring reports, are furnished to the Project Manager and authorization is received from the Department. The Department may require that certain BMPs be replaced by another type of BMP as a condition of permit transfer.
Upon approval of site conditions, measures, devices and all pertinent records, the Department will notify the Contractor to begin the Permit Transfer Notification in DEQ FACTS. Once completed, provide verification that all fees have been paid and the permit is ready for transfer in DEQ FACTS. The Department is not liable for the completeness or accuracy of Contractor records completed prior to the permit transfer. Ensure permit conditions and responsibilities are met until confirmation of the transfer is received from DEQ. Defend and hold the Department harmless from any violations, claims, enforcement actions, penalties or fines issued for Contractor activities or recordkeeping that occurred prior to the transfer of the General Permit.
If the Department concurs that final stabilization has been met during the final walk-through, the Contractor may submit a Notice of Termination form to DEQ. Pay the annual fee invoice due at the time of termination. Submit the annual fee invoice to the Project Manager for reimbursement.
2. MPDES Permit not Required.
The BMP-Administration item is included in contracts that may not meet either criteria for an MPDES permit but include ground disturbing activities. Complete BMP inspections and install BMPs, if necessary, in accordance with Section 208, if no storm water permit is required. Utilize form MDT-ENV-014, Water Pollution Control Inspection Report. A certified SWPPP Administrator is not required to conduct the inspections if no permit is required.
D. Method of Measurement.
DEQ MPDES fees and monitoring costs associated with obtaining and maintaining the General Permit for ground disturbance areas both within and outside the right-of-way are not measured separately for payment.
If no permit is necessary, include the cost of all erosion control, devices, and inspections in the BMP-Administration bid item.
E. Basis of Payment.
No additional payment will be made for the DEQ MPDES fees and monitoring costs associated with the General Permit. Include these costs in the Temporary Erosion Control-Lump Sum bid item.
For project including the BMP-Administration item, include the cost of all erosion control, devices, and inspections in the BMP-Administration bid item. Partial payment for the BMP-Administration will be monthly based on the lump sum contract price in accordance with Table 208-2 in Subsection 208.05.1.
Payment for BMPs required by an event or extra work, and approved by the Project Manager, will be measured and paid for in accordance with the Erosion Control Rate Schedule contained in the contract at a unit price of $1.00 per unit.
