About this file
This document is a Sole Source Justification (SSJ) memorandum for the Military Sealift Command (MSC) seeking to procure annual inspection, service, and testing of rescue boats and davits for the USNS MERCY. The procurement is specifically for rescue boat and davit parts (ISO 0653_A_TAH_CCSI) with Allied Systems Company as the sole source vendor, justified by multiple critical factors including exclusive licensing, being the original equipment manufacturer (OEM), and having unique technical expertise. The required delivery date is 02/05/2026, with an estimated production lead time of 18-20 weeks, and the procurement is for parts compatible with existing T-AH 19 and T-AH 20 vessel equipment.
The sole source justification is comprehensively detailed across several grounds: Allied Systems Company is the contracted designer and installer, the only source capable of ensuring correct material procurement, holds exclusive knowledge about rescue boat and davit parts, and can provide components compatible in form, fit, and function with existing equipment. Additional justifications include critical ship equipment classification, standardization requirements, and MSC's inability to evaluate non-OEM replacement parts without specialized technical information. The document leverages Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i) to support solicitation from a single source under the simplified acquisition threshold.

1. In considering the references, FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contacting Officers may solicit from one source if the Contracting Officer determines that, under the circumstances of the contract action, only one source is reasonably available (e.g., urgency, exclusive licensing, brand-name, or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition because only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

d. X OTHER:
MSC does not have manufacturing and technical information required to evaluate and determine wither non-OEM service and replacement parts offered are equivalent to the OEM components and replacement parts. This requires special tools and technical expertise unique to this equipment; only authorized OEM parts and service reps are authorized to work on the highly sophisticated equipment. The OEM has access to provide parts and technical data/drawings/service as required by USCG, ASME, SOLAS, and ABS certification
4. UNUSUAL AND COMPELLING URGENCY: The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits. Urgent requirements are supplies or services that will result in work stoppage, or are mission critical and the routine processing time would injure the Government. The determination that the procurement for the above is an urgent and compelling requirement is based on the following:
a. Date on which the requirement was identified:
b. Required delivery date / Period of Performance 02/05/2026
c. If the difference between a. and b. is more than one week, explain the delay in submitting t he requirement.
d. Estimated production lead time: 18-20 week
