JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY:
Requiring Activity:
Defense Logistics Agency (DLA) Troop Support Construction & Equipment Nicole Scott 700 Robbins Avenue Philadelphia, PA 19111 Nicole.Scott@dla.mil
Contracting Activity:
DLA Troop Support Construction & Equipment (C&E) Supply Chain Jennifer Marcakis 700 Robbins Avenue Philadelphia, PA 19111 Jennifer.Marcakis@dla.mil
2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED:
This justification authorizes the use of other than full and open competition for the procurement of Well Completion Kits particular to one manufacturer, Laibe Corporation (Cage Code: 4N8X6). The subject requirement will be solicited under the simplified acquisition procedures in accordance with FAR Part 13.5, for kits designed to complete drilled wells for production. The solicitation will be posted to the DLA Internet Bid Board System (DIBBS) and will be synopsized in Contract Opportunities (https://beta.sam.gov/). The resultant award will be a firm-fixed price contract.
3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS INCLUDING AN ESTIMATED DOLLAR AMOUNT:
Defense Logistics Agency (DLA) has a requirement to obtain Well Completion Kits to transform previously drilled wells into producing wells. The required kits, which are particular to a single manufacturer, are as follows:
Item Description: Well Completion Kit National Stock Number (NSN): 3820-01-618-2479 Manufacturer/Supplier Part Number: Laibe Corporation (Cage Code: 4N8X6) (Part Number D401321) Quantity: 6 Kits
The kits incorporate all steps for well completion including casing, cementing, perforating, gravel packing and installing a production tree. The Well Completion Kit works with Laibe’s Well Pump Kit, which contains the actual water pumps, motors, etc. The Laibe Well Completion Kit is currently the only product that works seamlessly with the Laibe Well Pump Kit.
The estimated unit price is per Kit. The estimated total dollar value of the acquisition is
Procurement Sensitive Source Selection Information – See FAR 2.101 and 3.104 interoperability, and packaging, another vendor could jeopardize the intent of the Army in establishing the kit.
Laibe Corporation’s kit is unique in its proprietary set of components and packaging designed specifically to meet the Army’s requirement and work seamlessly with the Laibe Well Pump kit. There are no other vendors to support this requirement without extensive development and testing in consultation with the Army. The Laibe Well Completion Kit is essential to the Government’s requirements. Additionally, due to the highly specialized nature of the equipment, it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the agency’s requirements. As the OEM, Laibe is the only source currently capable of meeting DLA’s needs. Other than full and open competition is justified.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED
FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:
The solicitation will be posted to the DLA Internet Bid Board System (DIBBS) and will be synopsized in Contract Opportunities in accordance with FAR 5.2. In addition, this J&A will be posted with the solicitation in accordance with FAR 5.102 (a) (6) and FAR 6.305(c).
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST
TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
As the Contracting Officer, I hereby determine the anticipated cost to the Government will be fair and reasonable. It is anticipated that the Government will use various price analysis techniques in accordance with FAR 15.404-1(b)(2), including, but not limited to comparison to historical prices paid by another branch of the military (Army) and prices obtained through market research for commercial items available to the public.
8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS:
A Sources Sought Notice was posted on Contract Opportunities on August 5, 2020, and two responses were received. Market Research was conducted via a Market Research Survey for this requirement and the same two vendors responded.
Internet searches for additional manufacturers, dealers, and distributors were unsuccessful.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION:
Laibe Corporation was
If one piece of the kit is unsuitable or missing, it is likely the unit will not be able to fulfill its mission. Another source, besides Laibe, would not be able to distinguish which parts and interoperability functionality are required to comprise a successful kit, nor would they recognize the SPI deemed necessary.
10. A LISTING OF THE VENDOR SOURCES, IF ANY, WHICH EXPRESSED IN WRITING AN
INTEREST IN THE ACQUISITION:
11. A STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT
ACQUISITION FOR SUPPLIES OR SERVICES:
At this time, the required Laibe Corporation Well Completion Kits are the only products that will support DLA’s current requirements and meet the Government’s needs. However, DLA Troop Support will continue to perform market research prior to any future acquisitions for this requirement. Procurement Notes M06, Evaluation of Offers for Part Numbered Items and L04, Offers for Part Numbered Items, will be included in the solicitation to encourage the submission of offers for alternate products. Any alternate offers received will be considered for future procurements only and forwarded to the Product Specialist for evaluation and approval. Additionally, DLA continues to exercise competition as often as possible and is required to conduct ongoing reviews of technology and corresponding services, both in private industry and in the Government. DLA uses a variety of vendors, manufacturers, and contracts/orders to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition to the maximum extent practicable. Requirements will continue to be posted on Contract Opportunities (beta.sam.gov) to ensure fair opportunity.
