52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsive and responsible offeror whose offer is determined to be the best value to the Government, based on price and other factors resulting from a comparative evaluation in accordance with FAR 13.106-2(b).
The following factors shall be used to evaluate offers:
Factor 1 – Technical Capability Offerors shall provide sufficient detailed information which demonstrates their technical capability to meet the requirements of the PWS. Offerors shall provide a document that addresses the following:
1. Corporate experience that demonstrates an offeror’s depth and breadth of experience meeting similar requirements to those outlined in the PWS (NO MORE THAN FIVE (5) PAGES IN LENGTH).
2. Key Personnel Qualifications – The experience, education, and qualifications of personnel proposed to work on the contract will be evaluated to determine their ability to perform their proposed duties.
i. Key Personnel documentation shall include:
Site Supervisor – resume shall demonstrate a minimum of three (3) years of experience in taking upper air observations. At least one year of this experience must have occurred during the last 3 years. The site supervisor must be an RRS certified observer.
Contract Manager – offeror shall provide name, title, and all contact information for a dedicated Contract Manager qualified to perform the duties outlined in the PWS.
3. A Draft Staff Management Plan (NO MORE THAN FIVE (5) PAGES IN LENGTH) to address proposed approach to meeting the staffing requirements of the PWS, that also includes:
i. A contingency plan that describes the offeror’s intention and ability to maintain all observation services in the event of a staff shortage (i.e., as a result of accident, illness, labor dispute, etc.); and
ii. An affirmative statement that the requirement for RRS certified observers will be met. Proof of required RRS certifications from the NWS will be required after award, but before performance for all proposed staff.
4. Draft Quality Control Plan for managing contract requirements, quality control deficiencies, site-specific issues, and ensuring quality of deliverables (NO MORE THAN FIVE (5) PAGES IN LENGTH).
Factor 2 – Past Performance Offerors shall demonstrate relevant past performance or affirmatively state that it possesses no relevant past performance. Relevant past performance is performance under contracts or efforts, within the past 3 years from the date of this solicitation that is of the same or similar scope, magnitude, and complexity to that which is described in the PWS.
The offeror shall provide a list of NO MORE than three (3) current/previous contract performance references that includes: contract numbers, points of contact with valid telephone numbers and email addresses, periods of performance, role on the contract (prime or subcontractor), and other relevant information.
Evaluation of past performance shall be based on the references provided, the quoter’s recent and relevant procurement history with NOAA or its affiliates, and/or any other available source of information available to the Government. A Past Performance Questionnaire (PPQ) may be sent by the Government, at its sole discretion, to the past performance references if deemed necessary. Data from the Past Performance Information Retrieval System (PPIRS), and/or any other available source of information, may be used at the Government’s discretion to supplement the references provided.
Past performance of a similar scope, magnitude, and complexity that demonstrates a minimum finding of satisfactory or higher by all considered sources will be found technically acceptable; however, past performance reports indicating greater than satisfactory may be deemed a better value to the Government.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will receive a neutral past performance rating.
Factor 3 – Price The offeror shall use the Pricing Schedule to quote all pricing, or an alternative form providing for the exact same format. The offeror shall quote all-inclusive firm fixed pricing, including, but not limited to, profit, overhead, G&A, without exception, to perform the work specified in the PWS.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Optional Line Items – Special Launches (CLINs 0001A, 1001A, 2001A, 3001A, and 4001A) will be evaluated at a Not to Exceed price of $5,000; however, the price per launch will be evaluated separately. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
As part of price evaluation, the government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the offeror's final option period prices to the offeror's total price. Thus, the offeror's total price for the purpose of evaluation will include the Base period, 1st option, 2nd option, 3rd option, 4th option, and adding an additional amount equal to 1/2 of the 4th option. As indicated in FAR 52.217-8 the government will have the option to extend the performance of the contract up to an additional 6 months when the contractor is provided written notice. Providing pricing for the optional six-month extension period is not requested or required

For line items covered by the WTO GPA, the Government will evaluate offers of U.S.-made or designated country end products without regard to the restrictions of the Buy American statute. The Government will consider for award only offers of U.S.-made or designated country end products unless the Contracting Officer determines that there are no offers for such products or that the offers for such products are insufficient to fulfill the requirements of the solicitation.
(h) Certification Regarding Responsibility Matters (Executive Order 12689). (Applies only if the contract value is expected to exceed the simplified acquisition threshold.) The offeror certifies, to the best of its knowledge and belief, that the offeror and/or any of its principals—
(1) □ Are, □ are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(2) □ Have, □ have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property;
(3) □ Are, □ are not presently indicted for, or otherwise criminally or civilly charged by a Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and
(4) □ Have, □ have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.
(i) Taxes are considered delinquent if both of the following criteria apply:
(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
(i) Certification Regarding Knowledge of Child Labor for Listed End Products (Executive Order 13126). [The Contracting Officer must list in paragraph (i)(1) any end products being acquired under this solicitation that are included in the List of Products Requiring Contractor Certification as to Forced or Indentured Child Labor, unless excluded at .]

[The contracting officer is to check a box to indicate if paragraph (k)(1) or (k)(2) applies.]
□ (1) Maintenance, calibration, or repair of certain equipment as described in FAR 22.1003-4(c)(1). The offeror □ does □ does not certify that—

(iv) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract is the same as that used for these employees and equivalent employees servicing commercial customers.
(3) If paragraph (k)(1) or (k)(2) of this clause applies—
(i) If the offeror does not certify to the conditions in paragraph (k)(1) or (k)(2) and the Contracting Officer did not attach a Service Contract Labor Standards wage determination to the solicitation, the offeror shall notify the Contracting Officer as soon as possible; and
(ii) The Contracting Officer may not make an award to the offeror if the offeror fails to execute the certification in paragraph (k)(1) or (k)(2) of this clause or to contact the Contracting Officer as required in paragraph (k)(3)(i) of this clause.
(l) Taxpayer Identification Number (TIN) (26 U.S.C. 6109, 31 U.S.C. 7701). (Not applicable if the offeror is required to provide this information to the SAM database to be eligible for award.)
