About this file

This is a Determination to Solicit from a Single Source under FAR 13.106-1(b)(1)(i) for a purchase under the Simplified Acquisition Threshold.

The U.S. Department of the Interior, Bureau of Reclamation, Lower Colorado Basin, Lower Colorado Dams Office seeks to procure 30 new SEL-735 revenue meters with color touchscreen (Part number 735#AQ81) from Schweitzer Engineering Laboratories (SEL), a large business registered in SAM. The meters are required to replace existing SEL-734 revenue meters at Hoover Dam that have reached end-of-sales status. The SEL-735 is the sole source solution because it is the only meter approved by the Western Area Power Administration (WAPA) based on operational and technical requirements for billing electricity between WAPA and Hoover Dam. The meters read power generation data and transmit MWH and MVH data to Hoover and WAPA databases, and any non-compliant metering data would jeopardize Hoover Dam's funding or cause significant payment delays. Additionally, the SEL-735 is built to order with specifications customized to Hoover Dam's needs per the memorandum of agreement between WAPA and Hoover Dam. While market research indicates several vendors offer standard SEL-735 meters, only Schweitzer Engineering Laboratories can manufacture the meter to meet Hoover's specific configuration requirements. Fair and reasonable pricing will be determined through market data analysis, current price lists, and comparison to historical pricing. The determination has been prepared and approved by the Contracting Officer.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Lower Colorado Basin, Lower Colorado Dams Office.

2. Name and Address of Single Source. Schweitzer Engineering Laboratories (SEL) Part number 735#AQ81, SEL-735 revenue meter with color touchscreen. SEL is registered in SAM as a large business

3. Description of Supplies/Services and Estimated Cost. This is a sole source supply requirement for 30 new revenue meters for Hoover Dam. Hoover Dam is currently using SEL-734 revenue meters to bill the Western Area Power Administration (WAPA) for electricity. The SEL-734 reads the power generated on the current units at Hoover Dam and sends the MWH and MVH data to Hoover databases and WAPA databases. Hoover is replacing the current SEL-734 revenue meters because they are at end of sales, in addition to requirements from WAPA’s expansion to the California Independent System Operator (CAISO) grid.

4. Description of Circumstances, including why only one source is reasonably available.

This justification supports the sole source procurement of revenue meters manufactured by Schweitzer Engineering Laboratories (SEL). The existing SEL-734 meters currently in use have reached end-of-sales and must be replaced. These meters serve as the primary devices for determining billing between WAPA and Hoover Dam; therefore, any replacements require WAPA’s approval. At present, the SEL-735 is the only meter WAPA has authorized based on its operational and technical requirements. Using a meter which does not meet these requirements would jeopardize Hoover Dam’s funding or cause significant delays in payment, as WAPA will not accept non-compliant billing data. Accordingly, the SEL-735 is the sole meter compatible with WAPA’s metering system, and the provisions outlined in the memorandum of agreement between WAPA and Hoover Dam.

In addition, although the SEL-735 meter is commercial, it is built to order based on a list of specifications specific to Hoover Dam’s needs. Simply buying a SEL-735 meter will not meet Hoover/WAPA requirements and specifications.
