About this file

This is a Determination to Solicit from a Single Source document from the Department of the Interior, Bureau of Reclamation's Lower Colorado Basin office in Boulder City, Nevada, justifying a brand name requirement for Pentair filtration equipment. The procurement is for two Pentair filtration systems (Item #930067), two Pentair immersible heaters (Item #LH35), and two Pentair temperature control boxes (Item #NA30DX), with delivery required within 60 days after receipt of order.

The justification explains that only Pentair products will meet the requirements due to compatibility with existing hatchery equipment and specific flow/filtration needs. While competition will be sought among qualified small businesses authorized to resell Pentair products, the brand name specification is deemed necessary for maintaining operational consistency and cost efficiency. The Bureau of Reclamation will continue monitoring the marketplace for future alternatives but has determined through market research that no other manufacturers currently offer compatible solutions that would integrate with the existing infrastructure.

(11/2020)

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Acquisition and Assistance, Lower Colorado Basin, Boulder City, Nevada.

2. Name and Address of Single Source. This is a brand name requirement to procure Pentair filtration systems.

3. Description of Supplies/Services and Estimated Cost. The current need is for two (2) Pentair filtration systems (Item Number 930067), two (2) Pentair immersible heaters (Item Number LH35), and two (2) Pentair temperature control – boxes (Item Number NA30DX), at an estimated cost of . Delivery shall be no later than 60 days ARO.

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13.106-1(b)(1)(ii), specific characteristics of the Pentair tank accessories are unique to Pentair alone. The required tank accessories are not available commercially off the shelf and are exclusively manufactured by Pentair. Other companies offer similar products, but they do not meet the required flow and filtration requirements in the same configuration as those already in use at the hatchery. Using systems with different components would necessitate different parts for repairs and replacements, increasing the long-term financial commitment. Identical components to those already installed will allow for interchangeability if needed. The Pentair tank accessories are currently in use on the existing systems. Using Pentair products ensures consistency, compatibility, and cost-efficiency in maintaining the hatchery's operations, thereby justifying the brand name specification.

5. Determination of Fair and Reasonable Price. In accordance with FAR 13.106-3(a)(1), the Contracting Officer anticipates that adequate competition will determine price reasonableness; and if adequate competition is not obtained, the Contracting Officer will perform necessary price analysis techniques such a comparison of the proposed price with prices found fair and reasonable on previous purchase or market analysis for similar items listed in FAR 13.106-3(a)(2)(ii).

6. Description of Market Research. Extensive research and evaluation have been conducted to determine the availability of alternative solutions. This included reviewing technical specifications, compatibility requirements, and cost implications of various tank accessories options. The findings confirmed that only the tank accessories from Pentair could seamlessly integrate with the existing Pentair tank accessories. No other manufacturers offer the tank accessories that are compatible with the current infrastructure. Only authorized resellers will
