DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

3. Description of Supplies/Services and Estimated Cost.
The Bureau of Reclamation, Albuquerque Area Office (Reclamation) has two LISST-Acoustic Backscatter Sensors (ABS) that have been monitoring suspended sediment concentrations in the Rio Grande at the Isleta Diversion Dam (IDD). The sensors were originally supplied by Sequoia Scientific, Inc. (Sequoia).
After more than a year of operation, the sensors were not collecting reliable data and required calibration before being redeployed. The sensors were removed from the IDD and sent to Sequoia for diagnosis. It was determined that in addition to calibration, one sensor will require repairs to become fully operational.
The total cost for the LISST-ABS sensors calibration and repairs exceed Reclamation’s service micro-purchase threshold amount.
Period of Performance: For 5 months from award date
Estimated Value of Procurement: $3,090.00
4. Description of Circumstances, including why only one source is reasonably available.
IAW FAR 13.106-1(b)(1)(ii), specific characteristics of the LISST-ABS that limit the availability to a sole source are specialized instruments developed by Sequoia for measuring suspended sediment concentrations in water. Only this suggested source can furnish the requirements, to the exclusion of other sources, because for the maintenance and repair services of the LISST-ABS sensors in the United States, Sequoia is the original manufacturer and possess the necessary expertise for servicing their instruments. Sequoia ensures that the LISST-ABS sensors receive appropriate care and that any maintenance or repairs adhere to the original specifications.

5. Determination of Fair and Reasonable Price.
The Contracting Officer has determined the price to perform maintenance and repair of the LISST- ABS sensors is fair and reasonable in accordance with FAR 13.106-3(a)(2)(i) and (vii).
6. Description of Market Research.
The market research provided by the Government’s technical expert, Ari Posner, verifies that only Sequoia can service and repair Reclamation’s non-working LISST-ABS sensors.
Further market research performed by the Contract Specialist (CS) confirms that Sequoia is the sole service provider for Reclamation’s LISST-ABS sensors. A DSBS search for NAICS 888120 in New Mexico resulted in 38 small businesses. The CS sent an email request for information to the small businesses found under NAICS 888120 and received 8 responses that indicated the Government’s requirement is out of scope or do not provide the repair and maintenance service of LISST – ABS sensors. Three additional responders replied to the request for information that their company performed service for LISST – ABS sensors and the CS supplied a copy of the Performance Work Statement for their review along with a request for their capabilities statement. The CS did not receive further communication from the three companies and were considered unresponsive.
Based on the market research performed, it has been verified that Sequoia is the sole service contractor for maintenance and repairs required for Reclamation’s LISST- ABS sensors requirement.
