DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

3. Description of Supplies/Services and Estimated Cost.
Manufacture Year: 2012 Manufacturer: John Deere Type: Excavator Model: 250G LC
The Bureau of Reclamation originally purchased the excavator for $252,544.73 in August 2012 currently located at the Socorro Field Division, in Socorro, NM. The excavator requires repairs and parts replacement based on several diagnostic tests performed by John Deere contractor and test results indicate service repairs exceed the government purchase card threshold amount. The Socorro Field Division will deliver Reclamation’s excavator to 4Rivers Equipment located in Albuquerque, NM within 7 days after a successful award.
Upon completion of repairs to excavator, a mechanic will be supplied by the Socorro Field Division to review and inspect the repairs. Reclamation’s excavator will be picked up from 4Rivers and transported back to the Bureau of Reclamation, Socorro Field Division office, by the Socorro Field Division after work has been found to be acceptable by the Government.

4. Description of Circumstances, including why only one source is reasonably available.
IAW FAR 13.106-1(b)(1)(ii), specific characteristics for service and parts to repair the John Deere 250G Excavator, that limit the availability to a sole source are proprietary software and availability of authorized John Deere dealers. Only this suggested source can furnish the requirements, to the exclusion of other sources, because 4Rivers Equipment is the only

WBR 1413.106-1 Template 1 (11/2020) authorized John Deere dealer in New Mexico that has the propriety software to properly diagnose, service and supply parts for John Deere construction equipment.
5. Determination of Fair and Reasonable Price.
The Contracting Officer has determined the price to repair the John Deere 250GLC Excavator is fair and reasonable in accordance with FAR 13.106-3(a)(2)(i) and (vii).
6. Description of Market Research.
The market research performed by the Government’s technical expert, Brian Skornia, verifies that only 4Rivers Equipment can service and repair Reclamation’s non-working John Deere excavator.
Additional market research performed by the Contract Specialist confirms that 4Rivers Equipment is the sole service provider for Reclamation’s 2012 John Deere, 250G LC Excavator. An internet search for fleet repair businesses resulted in 50% referrals to 4Rivers Equipment for John Deere construction equipment needs. The other 50% of businesses either did not have the capacity, software or did not offer construction equipment repair.
Other market research indicates it is in the best interest of the Government to repair the excavator instead of purchasing a new excavator. Depending on the care of the equipment, excavators can last from 10-15 years. A price search from other companies ranges from $199,500 up to $382,375 for a used excavator.
Based on the market research, it has been determined that 4 Rivers Equipment is the sole service contractor for repairs required for Reclamation’s 2012 John Deere 250G LC Excavator requirement.
