WBR 1413.106-1 Template 1 (11/2020)

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity.

U.S. Department of the Interior, Bureau of Reclamation, Acquisition Operations Branch, Denver, Colorado.

2. Name and Address of Single Source.

This is a brand name requirement to procure Leica Survey Equipment for Great Plains Bureau of Reclamation Regional Office in Billings Montana in order to replace end of life equipment.

3. Description of Supplies/Services and Estimated Cost.

The Bureau of Reclamation has a requirement to procure Leica survey equipment that includes:

two Leica MS60 Multi-stations, one Leica GS18 GNSS Antenna, three Leica GPR121 Prism, one Leica AP20 Tilt System, and associated accessories required.

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13.106-1(b)(1)(ii), it has been determined that Leica equipment is the only source available to fulfill this requirement due to proprietary technologies. This requirement is considered a brand name requirement due to Leica being the only manufacturer that has the ability to interface with the current infrastructure. Deviating from Leica would require additional equipment purchases to interface and mitigate interconnectivity issues with the existing equipment. Switching to another untested system within a short amount of time would not be possible without significant cost in resources, training, and re-programming existing tasks. It is expected that the duplication of costs could not be recouped if competed.

5. Determination of Fair and Reasonable Price.

The Contracting Officer will perform necessary price analysis techniques such as a comparison of the proposed price with prices found fair and reasonable on previous purchases (FAR 13.106- 3 (a)(2)(ii)), market analysis for similar items in the industry (FAR 13.106-3(a)(2)(i)), and other determinations listed in FAR 13.106-3(2) if the information is available to determine if the quoted price is fair and reasonable.

6. Description of Market Research.

The requested Leica products are the only brand that can interact with the current infrastructure.

The Bureau of Reclamations subject matter experts will continue to monitor the market for a possible replacement that is compatible with the current system for future requirements.
