DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity.

U.S. Department of the Interior, Bureau of Reclamation, Acquisitions Management Division.

3. Description of Supplies/Services and Estimated Cost.

Emergency response to repair underground pipe supplying water to the Brackish Groundwater National Desalination Research Facility (BGNDRF) fire suppression system.

Estimated cost $10,904.83.

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13.106-1(b)(1)(i), only one source will be solicited because of the urgency of this requirement. The Brackish Groundwater National Desalination Research Facility experienced a water pipe burst effecting the fire suppression system and blowing out most of the supporting fill material above and below the piping on October 20, 2024. This office became aware of the requirement on October 25, 2024. If immediate repair to the water piping is not completed within the next three weeks, more damage to government property may occur creating a hazardous work environment for staff working at BGNDRF.

5. Determination of Fair and Reasonable Price.

Price analysis was conducted to verify that prices charged for water pipe emergency response and repair are fair and reasonable. A search of the internet comparing pricing charged for removing damaged concrete, excavate pipe and fittings, and haul all debris, aligns with market pricing found on the internet for similar tasks. Same for the PVC pipe, bend fittings, restrain gland replacement, dirt back-fill, concrete trust blocks, and density testing expenses.

6. Description of Market Research.

Market research finds that emergency water pipe repair costs in a remote location such as Alamogordo, New Mexico are in line with the proposed prices. Due to the damaged water pipe supplying the facility fire suppression system, and the hazardous conditions near the building entry way caused by the burst pipe, there is urgency in completing repairs immediately to prevent a facility shutdown and further delays of inherently Government work missions being performed.
