DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity.

U.S. Department of the Interior, Bureau of Reclamation, Acquisition Operations Branch, Denver, Colorado.

2. Name and Address of Single Source.

This is a brand name requirement to procure Schweitzer Engineering Laboratories (Schweitzer) items/equipment for the Eastern Colorado Area Office. Competition will be sought on the Government Point of Entry (GPE) SAM.gov.

3. Description of Supplies/Services and Estimated Cost.

This requirement is for the procurement of Schweitzer relays. See table below for description, part number and quantity.

CLIN Description Part QTY 0010 SEL-400G 0400G0X6X11C6XXH8242424 4 Each 0020 SEL-311C 0311C11HP4J5422 7 Each

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13 .106-1 (b)(1), it has been determined that Schweitzer Engineering Laboratories equipment is the only brand available to fulfill this requirement due to proprietary technologies.

Based on the current configuration, the line and protection relays reach end of life and is risking system continuity if not replaced. Only specific components can interface with Schweitzer hardware/software. Deviating from Schweitzer would require re-engineering specific hardware/software that would not guarantee proper functioning and risk the integrity and continuity of the system. In addition, costs to restructure the system would duplicate that could not be recouped if competed.

5. Determination of Fair and Reasonable Price.

WBR 1413.106-1 Template 1 (11/2020)

The Contracting Officer will perform necessary price analysis techniques such as a comparison of the proposed price with prices found fair and reasonable on previous purchases (FAR 13 .106- 3 (a)(2)(ii)), market analysis for similar items in the industry (FAR 13.106-3(a)(2)(i)), and other determinations listed in FAR 13.106-3(2) if the information is available to determine if the quoted price is fair and reasonable.

6. Description of Market Research.

The requested Schweitzer Engineering Laboratories products are the only brand that can interact with the current infrastructure. The Bureau of Reclamations subject matter experts will continue to monitor the market for a possible replacement that is compatible with the current system for future requirements.
