JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION

In accordance with FAR 6.302 or FAR 13.501(a), the proposed contractual action is pursuant to the statutory authority identified in paragraph 4. This template is required for actions over the Simplified Acquisition Threshold (unless the procurement is acquired as a limited source IAW FAR 8.405-6 or is an Exception to Fair Opportunity IAW FAR 16.505(b)(2)).

1. Agency and Contracting Activity (FAR 6.303-2(b)(1)). U.S. Department of Interior, Bureau of Reclamation, Columbia-Pacific Northwest Region, Grand Coulee, Washington.

2. Nature/Description of Action (FAR 6.303-2(b)(2)). The Columbia-Pacific Northwest Grand Coulee Power Office intends to award a purchase order (PO) for Schweitzer Engineering Laboratory (SEL) Relays and related components which are required to provide current differential and overcurrent relay and motor protection of generating unit governors which control the speed of the generating units. Also, these relays monitor and control current differential on transmission lines that sends voltage to the power grid.

3. Description of Supplies/Services (FAR 6.303-2(b)(3)). The Grand Coulee Power Office has a requirement for SEL Relays and related switches to be used in the generators located in the Third Power Plant. The relays and switches are required to provide current differential and overcurrent relay and motor protection. The relays will be solicited as brand name only and the switches will be solicited as brand name or equal. The estimated delivery schedule is approximately 15 business days after receipt of order. The estimated value of these items is approximately .

5. Demonstration of Contractor’s Unique Qualifications (FAR 6.303-2(b)(5)).

Schweitzer Engineering Laboratories is the only manufacturer that can provide these relays. The specific characteristics of these relays limit the availability to a brand name due to the exclusion of other sources because they are the only source with access to existent proprietary hardware configurations and the software that works with Grand Coulee’s generating units. The relay system in use was purchased to meet the North American Electric Reliability Corporation (NERC), Western Electric Coordinating Council (WECC) and Critical Infrastructure Protection (CIP) requirements.

SEL also hold patent numbers 5041737, 5317472, 5479315 and 5963404 for SEL-387 series relays and patent 5436784 for the SEL-710 motor protection relay. These patents give SEL exclusive rights to make these relays and prevents other manufacturers from copying or profiting from them without permission.

6. Description of efforts made to maximize competition (FAR 6.303-2(b)(6)). This will be a brand name requirement for the relays and a brand name or equal for the switches.

Market research shows that there are distributors of this specific relays available that can provide competitive quotes. NAICS 335314 is designated for Economically Disadvantaged Women-Owned Small Business (EDWOSB). A search on SBA’s Dynamic Small Business Search website (DSBS) revealed 21 certified EDWOSBs. An email source sought was sent to all 21 and three responded expressing interest in providing quotes so this requirement will be set-aside for certified EDWOSBs.

7. Determination of Fair and Reasonable Cost (FAR 6.303-2(b)(7)). Fair and reasonable cost will be determined IAW FAR 13.106-3(a)(1), competitive quotations or offers. Although these relays are only available from one manufacturer, there are multiple distributors that can provide quotes. It is anticipated that two or more quotes will be received.

8. Description of Market Research Conducted (FAR 6.303-2(b)(8)). Market research was conducted by the contract specialist in July 2025. Research was conducted on GSA Advantage, DSBS, SAM.gov, Ability One, UNICOR, and Interagency Contract Directory. None of these sources provide SEL relays that meet the specific government requirements. Schweitzer Engineering Laboratories holds multiple patents for these specific relays and the relays for this procurement must be consistent and compatible with the current relays system in service. The NAICS 335314, Relay and Industrial Control Manufacturing, is designated for EDWOSB contractors. An email sources sought was sent to 21 contractors who were found on the DSBS and three responded and expressed interest in providing a quote.

10. Listing of Interested Sources (FAR 6.303-2(b)(10)). Three certified EDWOSBs have expressed interest in providing a quote.

11. Actions Taken to Remove Barriers to Competition (FAR 6.303-2(b)(11)). The requirement to purchase SEL brand relays will stay in place until the relay system is replaced, due to the configuration of the relay system.
