JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Identification of the agency and the contracting activity:

Mission Brazil is conducting this acquisition of American washer appliances on behalf of its consolidated warehouse, to replace inadequate, locally-manufactured appliances in government-furnished housing in Brasilia and Sao Paulo.

2. Nature and/or description of the action being approved.

This action is to approve the purchase of the specific brand and model of the Washer product described in Section 3 below.

The procurement is to be limited to specific models, for reasons cited in Section 5 of this JOFOC. The acquisition of the subject appliance models will result in a firm-fixed price purchase order.

3. A description of the supplies or services required to meet the Department's needs.

228 Washer Model, Whirlpool WFW5620HW

4. An identification of the statutory authority permitting other than full and open competition.

This acquisition is conducted under the authority 41 U.S.C. 3304(a)(l) as implemented by FAR 6.3, and substantiated by the following regulatory authority:

The regulatory authority is:

FAR 6.302-1, (c) this acquisition uses a brand-name description.

5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.

Consulate General Sao Paulo provides Furniture and Appliance Pool stock, maintenance, and procurement for all of Mission Brazil. In order to ensure commonality of parts and ability to service models across Mission Brazil, it is essential that a commonly available brand, with parts commonality widely available, be used. In order to maintain and transfer new equipment in and out of Mission residences not only in Sao Paulo but in other posts, these appliances need to be interchangeable to the maximum extent possible. Procuring a wide variety of brands and models will prohibit the Mission from acquiring sufficient replacement parts to ensure continued operational readiness, and will limit our appliance repair technicians’ ability to develop expertise in diagnosing and correcting maintenance issues.

Due to the eccentricities of Brazil’s wide variety of electrical and gas supply systems from one post to another, post GSO conducted extensive research to identify brands and models that would work across posts. We considered size/space limitations, efficiency, varying electrical grid capacities, and installation costs and complexities in identifying models that meet our needs. Failure to observe the exact specifications as listed in this RFQ could lead to an inability to use the purchased units in all

Mission residences, further complicating efforts to maintain a widely common appliance pool.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

Other than the requirement for the specific brand and model, this procurement will be competed to the fullest extent practicable. The solicitation will be posted SAM.gov. In

Accordance with FAR 5.102 (a) (6), the justification shall be posted with the Solicitation.

7. A determination by the Contracting Officer that the anticipated cost to the

Government will be fair and reasonable.

The Contracting Officer (CO) will determine that the contract prices are fair and reasonable based on competition and comparison to the IGCE.

The IGCE was based on widely available pricing information found on the GSA

Advantage website, based on existing USG-negotiated pricing agreements.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

The market survey was conducted using the GSA Advantage website and reviewing available vendors, makes, models, and pricing. Once potential models and makes were identified, the GSO and Facility Management teams at Consulate General Sao Paulo and

Embassy Brasilia reviewed the specifications of each to ensure they met both posts’ needs.

9. Any other facts supporting the use of other than full and open competition.

Mission Brazil attempted to transition to locally-manufactured appliances. These have been determined to not meet the needs of Mission residents or leadership, as the quality, size, and utility of the appliances are not suitable for use in American residences.

10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.

GSA Advantage lists a number of vendors and previously-contracted price levels, that are able to provide the quantities required. In addition , the synopsis /solicitation will be posted on SAM.gov.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Include a statement that this J&A for other than full and open competition will be published on SAM.gov in accordance with FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.)

Combined synopsis/solicitation will be posted on SAM.gov for at least 40 days. This J&A will be published in accordance with FAR Section 6.305 within 14 days of award.
