Questions and Answers
Q1: Can the vendor quote one year at a time? Will the Government accept new price lists submitted on a yearly basis? Or does the Government require a five year commitment?
A1: This solicitation is for a BLANKET PURCHASE AGREEMENT (BPA), which is not to be confused with a purchase order, delivery order, or task order. BPAs are NOT CONTRACTS, therefore; there is no obligation or commitment on either party. Call orders, which are written off BPAs, are the
CONTRACTUAL OBLIGATION component of BPAs. In accordance with FAR 13.303-6(b), the contracting officer will annually review the BPA, in which the Government may make new arrangements or modify existing arrangements. At the time of annual review, the vendor may update their price lists. For more information on agreements, please see FAR 13.303 and FAR Subpart 16.7.
