Questions & Answers W91ZRU-17-R-0008 POTFF Program Support

31 Aug 17

Q01: I am writing to better understand the professional that is being requested in this section of the PWS (section 1.8.2.) for the POTFF solicitation. I wanted to be clear that this section is requesting an "Athletic Trainer" to perform these services and this individual does not have to be a "Physical Therapist."

A01: Yes, the government is looking for athletic training services.

Q02: Is this a new requirement?

A02: The Orthopedic Manual Physical Therapy (OMPT) and Strength and Conditioning (SCS) services are previous/current requirements while the Operational Psychology (OP) and Physical Therapy/Injury Management (PT/IM) services are new.

Q03: Who is the incumbent contractor?

A03: Tactical Fitness and Performance

Q04: What is the contract number for the current contract?

A04: W91ZRU-13-P-0124 with the most recent extension being W91ZRU-17-P-0017.

Q05: What is the total period of performance for the incumbent contract?

A05: The contract started 25 Sept 2013 and is still in place. Several modifications/extensions were completed for this contract.

Q06: What was the total value of the incumbent contract?

A06: Total value of all contract actions for these services is approx. $1,000,000.00.

Q07: What was the price for each option year on the incumbent contract?

A07: There were no option years for this contract. Please see A05 above.

Q08: Are there any vacancies on the incumbent contract?

A08: See A02 above. These current positions have not been hard to fill in the past.

Q09: Does the proposal response have to be hard copy or can it be emailed instead?

A09: See page 26 of solicitation under A(2) “Proposal Submittal and Inquiries”. It states “Electronic submission via email or fax will not be accepted. Hard copy proposals may be mailed or hand delivered to TSgt Zachary Gowin or TSgt Nicole Rahmer, 17441 Airlifter

Drive, Joint Base Elmendorf-Richardson, AK 99506. USPS is not recommended due to delays in receipt of mail.”

Q10: How would the Government like offerors to provide pricing (e.g. will the Government provide a pricing sheet)?

A10: Please see page 27 of the solicitation under “Volume III – Price (Factor 2)”. Pages 3 through 10 provide the CLIN structure that offerors should emulate when providing pricing. A pricing sheet will not be provided as this allows prospective contractors the ability to provide innovative solutions to the services requested. For example, a prospective contractor may elect to propose combining two or more services into one position.

Q11: Will the Government please provide the number of hours it requires for each labor category under this requirement?

A11: Operator hours are detailed on page 1 of the Performance Work Statement (PWS) under “Operating Hours” (section 1.4.1). This section states “...The contractor must ensure that services are available daily for squadron personnel on both shifts.” Performance standards are outlined on page 26 of the PWS which will be used to measure contractor performance for each service solicited.

Q12: Please confirm that the Government is seeking full coverage for all labor categories for all Operating Hours.

A12: See A11 above.

Q13: Are there additional known days that the facility will be closed, for example family days?

A13: Please see sections 1.4.2 through 1.4.5 of the PWS (pages 2-3).

Q14: Pursuant to FAR 52.212-4 CONTRACT TERMS AND CONDITIONS-- COMMERCIAL ITEMS (JAN 2017), can you confirm that we are to invoice monthly and we will be paid within thirty days of our invoice?

A14: Yes, invoices will be monthly and payment is made within thirty days of invoice. Historically for these services, this is how it has been done and payment has been within 30 days.

Q15: Please address how Travel CLIN 0002 and optional Travel CLINs 1002, 2002, 3002, 4002, and Manpower Reporting CLIN 0003, and optional Manpower Reporting CLINs 1003, 2003, 3003, and 4003 are to be priced. Each of these CLINs are FFP and each identifies a quantity of “1” and the unit as “job.”

A15: Please see section 1.13 Contractor Travel of the PWS. Costs associated with this CLIN will be discussed and negotiated after award and are subject to change. This CLIN will not be competitively priced and considered during the evaluation of proposals. The contractor will be reimbursed for costs associated with travel according to the PWS. A not to exceed dollar amount will be stated in the contract which will provide a ceiling of costs that the prospective contractor will not exceed. Pricing for the Manpower Reporting is at the discretion of the contractor and is based on the administrative costs associated with providing this information.

Some contractors will separately price these costs while others will build the price into the other services (overhead costs and G&A). By annotating the unit as job, this allows the vendor to invoice different partial payments for the same line item.

Q16: Paragraph 1.14 in the PERFORMANCE WORK STATEMENT (PWS), dated 19 July 2017 for Solicitation W91ZRU-17-R-0008 stipulates “…All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government…”. We are confused by this assertion as it conflicts with Intellectual Property law along with DFARS 252.227-7013 Rights in Technical Data--Noncommercial Items, and 252.227-7014 Rights in Noncommercial Computer Software and Noncommercial Computer Software Documentation. Please explain how the government can legally acquire such ownership rights. We understand that the FAR and DFARS allow for certain “use” rights by the government, but not “ownership” rights.

A16: Due to the POTFF being a commercial requirement, these clauses are not applicable and should not have been included in the solicitation. Both clauses will be removed in the contract award.

Q17: What liability protections will be given to the Ops Psych position?

A17: Please see FAR 52.237-7 in the solicitation.

Q18: How will the Ops Psych position be coordinated with military Psych services?

A18: Please see sections 5.3.4.7 and 5.3.4.10 in the PWS.

Q19: What are the expected outcomes of the Ops Psych position for operator readiness and resilience?

A19: Please see section 5.3.4 OP Requirements in the PWS and Technical Exhibit 1 – Performance Requirements Summary (page 26 of PWS).

Q20: Will there be a budget for technology related to advancing operator health, readiness, and performance?

A20: No budget is provided for technology. However, contractors are encouraged to provide innovative solutions or processes for the services solicited for in the solicitation. Costs associated for these should be priced separately and explained in sufficient detail to provide rationale on how they are used to support the overall objectives/services asked for.

Q21: The Ops Psych position you seek to fill is highly specialized and hard to procure. Has any proportional market research specific to Alaska been performed? If so what realistic consideration has been given to commensurable experience? The SOCOM POTFF employs a GS 14 and higher talent pool.

This classification does match the public sector salary opportunities most especially within professional sports.

A21: The government is of the understanding that this service is highly specialized and may be difficult for prospective contractors to provide. We ask that contractors illustrate the ability to provide or not provide this service. Depending upon contractor responses, the government may not contract for this service, especially if it is cost prohibitive.

Q22: What are the current services in place and what is the contract reference identifier? How is it currently structured and are they in Alaska?

A22: Please see Q02 through Q08 above.

Q23: If a qualified candidate cannot be found in AK is there a plan?

A23: This requirement is being solicited nationwide as a total small business set-aside. It is not necessary for the contractor to be located within the immediate area and/or state.

Q24: Is this a full time 40 hr position or is it a position that can be filled on a monthly rotation?

A24: Please see Q11 above.

Q25: What State governs a "Valid State License" for this performance? Does it have to be AK?

A25: A valid license from any state is sufficient – it does not have to be from Alaska.

Q26: PWS, Page 14, Section 1.13 Contractor Travel: In order to provide a bid that can be compared for cost realism, request the government provide a list of anticipated travel, to include location, dates and duration or provide a travel plug number or a not to exceed number for evaluation purposes.

A26: Please see Q15 above.

Q27: PWS, Page 18, Section 4. Contractor Furnished Property Materials and Equipment & Section 4.1, General: What equipment or tools are currently provided by the existing offeror?

A27: Sections 3.2 and 3.3 of the PWS have been revised. Please make note to the changes in these sections and the addition of a spreadsheet/attachment titled “Gym Equipment”.
