1. GENERAL: This is a non-personnel services contract to provide the compressed gas products and services specified in the scope. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to provide the compressed industrial gases and specialty calibration gases as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.

1.2 Background: The mission of ATC is to plan, conduct, analyze, and report the results of developmental tests, production tests, and other tests to include providing test and test support services for authorized customers, within Department of Defense (DOD) and outside DOD, including government and non-government organizations, domestic and foreign in the support of the warfighter. ATC is one of the DOD’s premier test and training ranges supporting both military and commercial materiel developers by testing a broad spectrum of equipment throughout the life cycle, from concept through deployment. ATC is a tenant on APG and encompasses land and water totaling approximately 70,000 acres with an extensive inventory of facilities. ATC is organized by Directorate competencies with approximately 2500 personnel that consists of government civilian, military, and contractors.

1.3 Objective: The contractor shall provide the specified compressed gas products required for the normal operations of ATC.

1.3.1 Requirements:

1.3.1.1 Deliveries can only be made Mon – Thurs between the hours of 7:00 AM and 3:30 PM. Your delivery personnel must call the appropriate TPOC/COR, prior to delivery to ensure someone will be available to process the delivery.

1.3.1.1.1 All drivers must meet security requirement to enter onto APG along with accessing the Restricted Area.

1.3.1.2 All cylinders supplied must be labeled in accordance with applicable Federal and State regulations.

1.3.1.2.1 Contractor will be required to label any cylinders without DOT stickers. Contractor must be prepared and have stickers available to remove cylinders from government facility.

1.3.1.3 Ensure that all vendor supplied cylinders are hydrostatically tested and inspected as required by CGA, Federal, and State regulations.

1.3.1.4 Any and all applicable costs you incur to meet the terms of this contract must be factored into the unit price of the gas. We will not pay demurrage on cylinders. The length of time we might keep any given cylinder is indefinite; for instance, cylinders containing specialty (calibration) gas mixtures may be held until their expiration date. All vendor provided cylinders will be returned upon termination of this contract.

1.3.1.5 As part of your proposal, you shall include as a separate line item provisions for returning unused, but expired, calibration gases for re-certification and re-issue to ATC. Re-certified gases shall meet all provisions of paragraph 1.6.2.2.

The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.

1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.2.1 All pure gases (regardless of grade) shall be batch analyzed and the batch analysis identifier must be affixed to each cylinder.

1.6.2.2 All calibration mixtures shall be single-certified to meet the specified concentrations within the tolerances stated in Table 1. You shall provide a certificate of analysis (COA) for each cylinder. At a minimum, COAs shall state:

i) National Institute of Standards and Technology (NIST) traceability,

ii) certification or analysis date,

iii) expiration date, and

iv) certified concentration(s).

1.6.2.3 The balance gas for all calibration mixtures listed in Table 1 and 2 will be nitrogen.

1.6.2.4 For gases having a shelf life, a minimum of 90% of the shelf life must remain at the time of delivery to the government.

1.6.3 Recognized Holidays: The vendor will not be required to make compressed gas deliveries on the following Federal Holidays.

New Year’s DayLabor Day
Martin Luther King Jr.’s BirthdayColumbus Day
President’s DayVeteran’s Day
Memorial DayThanksgiving Day
Independence DayChristmas Day

1.6.4 Hours of Operation: ATC is currently working an alternate work schedule as described in ATC regulation 690-9. The contractor shall be required to make cylinder deliveries and pickups during these hours.

INSTALLATION CLOSURES. Inclement weather conditions may force a temporary shutdown of APG. The contractor shall call the Post Operation telephone (410-278-SNOW) to get APG operation status and report to work accordingly. In addition, the local radio stations will announce any such delays or closures.

1.6.5 Place of Performance: Delivery and pick-up of compressed under this contract will be performed at Aberdeen Test Center, APG MD 21005. Refer to section 1.4 (Scope) for building locations for specific compressed gas product delivery/pickup.

1.6.6 Type of Contract: The government will award a Firm Fixed Price (FFP) contract.

1.6.7 Security Requirements: The contractor must ensure that the driver for all deliveries is a US Citizen and is able to gain access to the Aberdeen Test Center Restricted Area (RA).

1.6.7.1 PHYSICAL Security: The contractor shall be responsible for safeguarding all government equipment/property provided for contractor use.

1.6.8 Special Qualifications: Question for Scott Sattler...does the weld shop want to specify anything here?

1.6.9 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced.
